Bikie boss taunted enemies before shooting

Comancheros boss Vincenzo Focarelli taunted his enemies online and posted video of himself shadow-boxing before his son was shot dead and he was seriously wounded in a shooting attack last night.

The leader of the outlaw bikie gang is now in hospital refusing to co-operate with police after surviving a fourth attempt on his life.

Focarelli suffered multiple gunshot wounds and his 22-year-old son, Giovanni, died at the scene after the shooting on Sunday night at Dry Creek, in Adelaide's northwest.

Just last month, after surviving a gunman's ambush at Munno Para West, Focarelli bragged on Facebook about being "the only man on the planet with nine lives" who "feels like a rock star" from all the media coverage on his narrow escapes.

The bikie boss was seen in a YouTube clip posted earlier this month that shows him shadow-boxing for the camera in a video that appears to promote life in the Comancheros gang in Adelaide.

Now recovering at Royal Adelaide Hospital after this latest shooting, Focarelli is refusing to tell police who shot him and killed his son.

Detective Superintendent Grant Moyle said police will do everything they can to prevent retaliation.

"I would suggest it was a very planned, targeted attempt on his life," he told reporters in an overnight press conference.

"It is a concern to us that retribution might take place, but we will do what we can to talk sense into these people.

"He has declined to provide us any information that might assist us in identifying the offender.

"That is a difficulty we face in these particular cases.

"The people that do know information are often reluctant to assist the investigation."

South Australian Police Minister Jennifer Rankine is being briefed on the shooting by Police Commissioner Mal Hyde.

She said police are doing their best to deal with the scourge of outlaw gangs and SA has very tough anti-bikie laws.

"Hundreds of them have been arrested and charged. Hundreds of their associates have been arrested and charged," she told ABC Radio.

"The frustration is these people have absolutely no regard for the law or, it would appear, for their safety or the safety of the community."

Police are doorknocking an area near Flame Avenue in Dry Creek where they believe the Focarellis were shot.

Vince Focarelli, who is believed to have been wounded up to four times, apparently bundled his son into a car and drove it towards the city, waving a police car down in suburban Prospect.

Giovanni was dead by the time an ambulance crew arrived.

The 22-year-old had also been attacked before and had refused to co-operate with police investigating his attempted murder.

Part of Prospect Rd was cordoned off overnight while police examined the Focarellis' car.

About half an hour after the shooting a group of people arrived and had to be restrained by police from entering the crime scene.

News Ltd said one woman had to be tackled by three officers.

Dry Creek resident Steven Basilico, 15, said his family heard three to four shots around 8.30pm (CDT) on Sunday.

"It was pretty frightening," he told journalists as he headed off for the first school day of 2012.

He said they believed it was a drive-by shooting at a nearby park.

Neighbour Peter Frost, an electrician, said it was normally a quiet suburb.

"You read about (shootings) in the paper and usually it's the other side of town, you don't worry about it," he told AAP.

"I thought (the shots) were firecrackers," he added.

Mr Frost said police were door-knocking in the area until 3am (CDT). They are still investigating in the cordoned-off street.

THEY clean toilets, drive taxis and wait on tables - jobs "beneath" so many Australians the Government is considering importing thousands of migrant workers to fill some critically short-staffed industries.

A growing underclass is developing in Australia, once revered for its work ethic, where entire occupations are being left almost entirely to foreigners.

Experts say high-paying mining jobs are luring young Australian workers from traditional fields such as retail and hospitality, while others would rather go on the dole than muck in and do certain jobs themselves.

"I hate to say it, but there does seem to be a sense of entitlement now among younger Australians," Tourism Accommodation Australia boss Rodger Powell said.

"They believe jobs in the service industry are too menial or too low paid and they have been brought up to believe they are destined for something better instead of starting from the bottom and working their way up as generations did before them."

The hospitality and tourism industry is so short-staffed the Government is in discussions to import 36,000 cooks, waiters and bartenders to fill vacancies.

Another 56,000 will be needed by 2015, according to Federal Immigration Minister Chris Bowen.

Under the plan, tourism and hospitality employers would be able to bring in workers on a two or three-year visa, similar to the 457 visa program widely used in the mining sector.

"Of course employers would need to show they are doing their best to employ and train domestic workers and paying market rates," Mr Bowen said.

While hospitality is struggling to fill vacancies, some sectors are being shunned.

"It's very rare to have an Australian work as a commercial cleaner," Australian Cleaning Contractors' Alliance director John Laws said.

A spokeswoman for the cleaning union United Voice said competition for contracts was so fierce some companies bid at a loss and used illegal practices such as cash-in-hand payments.

A black market of illegal workers is said to extend across other businesses, such as restaurants and general labouring.

A JUDGE has reserved his decision on child killer Ramazan Acar's attempt to appeal the length of his life sentence with a 33-year minimum term.

Acar, 24, was handed the sentence in July last year after pleading guilty to murdering his two-year-old daughter Yazmina.

He has appealed on grounds including the sentence was manifestly excessive.

Acar was dubbed "the Facebook killer" because he posted chilling messages on the social network site about his plans to kill his daughter.

One of his messages read: "bout to kill ma kid".

After abducting Yazmina, he stabbed the little girl and dumped her body.

When sentencing Acar, Justice Elizabeth Curtain told him: "You killed your daughter to get back at her mother".

Acar appeared in the Court of Appeal via video link from Port Phillip Prison today.

His barrister, Gavan Meredith, told Justice Mark Weinberg that the sentence was manifestly excessive for several reasons, including Acar’s remorse, his early guilty plea, his young age and the fact he co-operated with police.

Mr Meredith said the sentencing judge had not taken into account evidence from a psychologist about Acar’s emotional state and underlying personality disorder.

Prosecutor Brett Sonnet said Acar’s crime clearly fell into the worst category of murder and the sentence was open to the judge.

Mr Sonnet submitted that Acar knew his intended actions were demonstrably and terribly wrong.

Justice Weinberg has reserved his decision until next week.

The legal system sees males as agressors, and it is the actions of Acar that support these views.

Some 'backwards' (including the United States), countries see fit to take a life for a life, ie. the death penalty is called upon.

A 33 year minimum means he can be out a lot earlier, as many cases of murder have had the criminal released much ealier than the minimum system.

Criminals are led out into the community by the corrupt legal system, in order to re-offend.

Since Australia has done away with the death penalty, and there is NO turning back, life imprisonment without parole should be the only alternative.

THE gap between our best and worst students is widening and our top academic performers are slipping by world standards, the Government has conceded.

The official Naplan 2011 report concludes there has only been a "small number of improvements" in literacy and numeracy since national testing was introduced four years ago.

While almost 94 per cent of students are hitting minimum benchmarks for the fundamentals of learning, Federal Education Minister Peter Garrett admitted some of the results were concerning.

"Our best-performing students are not doing as well as they were 10 years ago, while the gap between the top and bottom students has increased," said Mr Garrett, who released the report yesterday. "This is not acceptable in a country as wealthy and well-resourced as Australia.

"Our neighbours in the Asian region have raced ahead of us. We need to provide the highest quality education to all our children. This includes understanding why our results are not as good as they could be."

The National Assessment Program - Literacy and Numeracy 2011 report had mixed results for Victoria, showing its rural pupils were bucking the national trend of dominance by city students, performing "exceptionally well".

In every other state, rural students trailed their city counterparts in reading, writing and numeracy.

However, Victoria still has one of the worst Naplan participation rates, despite efforts to force students to sit the tests. The report, which covers tests sat annually by students in Years 3, 5, 7 and 9, also showed parents' jobs and education level were key indicators of performance at school.

More than 98 per cent of grade three students with "professional" parents hit minimum standards in reading, for example, compared to less than 88 per cent of those whose mums or dads were unemployed. Naplan testing has been dogged by controversy since it was introduced in 2008.

Some schools are accused of encouraging less-talented students to stay at home on test days to boost results.

The next round of tests will be on May 15-17.

Opposition education spokesman Christopher Pyne said: "Despite the billions spent by the Gillard Government, there has not been any tangible improvements in the only area that really matters - educating young people".

THE Prime Minister's office has rejected suggestions by Buckingham Palace that the Royals footed the bill for gifts given during the Queen's tour Down Under.

The Queen and other members of the royal family have charged Aussie taxpayers thousands of dollars for gifts they gave to dignitaries.

The Queen and Prince Philip handed out dozens of framed photographs of themselves and other mementos as thanks to their hosts during their tour last October.

But the gifts were actually paid for by the Australian Government.

A Buckingham Palace spokesperson today attempted to deny the Herald Sun's report that Australian taxpayers were paying for gifts handed out by the Royals.

"The Royal Household pays for gifts given by The Queen - not Australian taxpayers," the spokesperson said.

But a short time later, the PM's office has again confirmed the report.

“Consistent with longstanding practice the Australian Government will meet the costs of gifts presented by The Queen during her visit to Australia," a spokesman said.

Prime Minister Julia Gillard and about 40 other Australian officials received the gifts, which cost almost $15,000 - the spokesman reaffirmed.

In a little-known regal protocol known as passing costs "to the realms", the practice of Commonwealth citizens paying for royal gifts has been going on for decades.

Prince Charles, during his tour of Australia several years ago, hit taxpayers for the cost of photographs, trinkets and even copies of a gardening book he co-wrote when he handed them to officials.

Charles gave away 16 framed pictures of himself, a pen knife, three wallets, a fountain pen and a planter box shaped like a sheep.

On top of the gifts, Australian taxpayers foot the bill for royal travel - estimated at about $1 million for the Queen's 2011 visit and $350,000 for Charles' 2005 tour and another $600,000 for his 1994 trip.

Those costs include flights, accommodation and phone calls as well as expenses such as meals and mini-bar bills.

"On their own they are reasonably small costs in relation to overall government expenditure," Australian Republican Movement chairman Michael Keating said.

"But if people are unhappy about these quite bizarre costs, if we want to stop kowtowing and giving these funnily funded gifts, we want to get to the real issue which is becoming a republic."

But Australians for Constitutional Monarchy chairman Prof David Flint said the Queen should not be expected to personally pay for the gifts.

He said an Australian president in any future republic would not be expected to pay.

A spokesman for the Prime Minister's office said the Queen and Prince Philip presented Ms Gillard with framed photographs and a silver box during last year's visit.

More News 50 drink-drivers lose licence each day during police blitz

DRINK-DRIVERS have been banished from Victorian roads at a rate of almost 50 a day during a major police blitz.

Acting Chief Commissioner Kieran Walshe said he was disappointed 2610 people lost their licences for exceeding their alcohol limit during operation Summer Stay.

“The behaviour of each one of these drivers could have resulted in a tragedy,” Mr Walshe said.

More than 1.1 million people were breath-tested during Summer Stay, which ran for 52 days until midnight Sunday.

The highest number of drink-drivers was caught on the Mornington Peninsula, where 88 people lost their licences.

A Victoria Police spokeswoman said there had for a long time been a “cultural” problem with drink-driving in the area.

The next worst places were Yarra Ranges with 85, Dandenong with 62 and Stonnington with 61.

Mr Walshe said the drink-drive test rate of one positive per 432 motorists was poor but an improvement on the one in 332 from last year.

“This shows that even more motorists are becoming well and truly aware of the dangers of drink driving and are making the right choice by not risking their lives and the lives of others,” he said.

Summer Stay also detected 397 drug-drivers, 4510 disqualified and unlicensed drivers, 3584 seatbelt breaches, 23050 speeding offences and 5734 breaches of mobile phone laws.

Police said 433 cars were impounded.

Transport Accident Commission chief executive officer Janet Dore said the rate of speeding detected during Summer Stay was a “disgrace”.

“These people should really count themselves lucky that they have only been handed a fine and haven’t killed someone,” Ms Dore said.

Ninety Victorians died in road accidents linked to speeding last year.

“To learn that more than 23,000 drivers have put their lives and their passengers’ lives at risk by driving too fast was incredibly disappointing, and something that our community should be ashamed of,” Ms Dore said.

Mr Walshe said he found the seat-belt figure astounding.

“There is nothing more frustrating for police than attending a fatal collision where we know that a person would have sustained only minor injuries should they have been wearing their seatbelt,” he said.

The government on many occassions has provided fraudulent information to put forward a political agenda, the most publicised one, being that of crime figures for Melbourne, Victoria.

If the figures are to be believed what the Victorian Police claim them to be, they are quite shocking.

Unfortunately thers is a percentage of society known as trailer park trash, that will continue to put others lives at risk by drink driving.

Australia's youth culture is that of binge drinking, also amongst others disrespect for road laws and other motorists.

These people should not be in posession of a drivers license for any period of time, let alone the suspension of one.

In order to implement safe roads, the government allocate more resorces, which will not bring in the desire revenue that for example speeding fines do.

GUNS outnumber people in 24 Victorian towns a special investigation has revealed, and the anti-gun lobby is horrified.

The East Gippsland hamlet of Swifts Creek has the highest ratio: 774 registered firearms shared by just 278 residents, the Herald Sun reports.

Annual figures show an increase of 62 per cent in robberies involving firearms in Victoria.

Detective Supt Brett Guerin, head of Victoria Police's serious crime division, said those involved in recent lawless behaviour in Melbourne's northwest suburbs had been "shooting up the streets as if it's the wild west". He reinforced the police strategy of "unremitting harassment" to deter the use of firearms.

The 3551 postcode, taking in towns on the outskirts of Bendigo, had the highest number of registered guns - 7179. French Island in Western Port Bay and Harrow, in the Wimmera, rounded out the top three gun hot spots.

Victoria has 642,176, or nearly 23 per cent, of the 2.8 million firearms registered in Australia.

Police are worried after more than 39,000 extra firearms were registered in Victoria in 18 months to June last year, despite an increase of only 5000 in the number of licensed shooters.

They said their biggest concern was the number of pistols in the community and people's willingness to use them to commit crimes.

Senior police said they would blitz gun dealers and licensed shooters to try to stop legal firearms getting on the black market.

It comes as figures show registered guns now outnumber people in 24 Victorian towns.

The highest proportion is in the East Gippsland hamlet of Swifts Creek where 278 residents own 774 firearms.

Other hot spots are French Island in Western Port Bay and Harrow, in the Wimmera.

Police figures also show:

UP to 200 (75 per cent) of all pistols seized from criminals in the past three years had never been registered or could not be identified.

FORTY-ONE of the 273 firearms seized were stolen.

MORE than half the firearms used in "high end" armed robberies last year were pistols.

FIFTEEN per cent of firearms seized from criminals were stolen weapons.

The annual figures showed an increase of 62 per cent in robberies involving guns and a 15 per cent increase in assaults with a firearm.

Detective Supt Brett Guerin, head of the force's serious crime division, reinforced the police strategy of "unremitting harassment" to deter the use of guns, particularly pistols.

Supt Guerin described those involved in recent lawless behaviour in Melbourne's northwest suburbs as "peasants ... acting in a way they would in the foothills of their home country, shooting up the streets as if it's the wild west".

"Instead of farming they rob people, or stand over them or sell dope - and they use firearms to enforce it," he said.

"We can't just wait for these matters to be fully investigated and brought before the courts one or two years down the track. We've got to start making life difficult for these peanuts."

The head of the force's licensing and registration division, Supt Russell Barrett, said shootings in Melbourne had emphasised the issue of illicit gun use.

"I don't think the issues we're seeing are with the licensed shooters. The problem is not with the lawful weapons in the hands of lawful shooters," he said.

"Our focus for the next 12-18 months will be to ensure that not only the right people get licences and access to guns, but to ensure that legal guns don't become illegal."

Supt Barrett said police would be strong on regulating the practices of dealers and ensuring owners were storing firearms safely.

He said he hoped a big drop in the number of firearms stolen - 142 in 2010-11 compared with 316 the previous year - was a reflection of more secure storage.

Only 18 of the 302 guns reported stolen in Victoria in 2008-09 were recovered, the most recent Australia Institute of Criminology firearm theft statistics show.

Pistols registered rose from just over 11,200 in June 2010 to 11,600 a year later.

After the Port Arthur massacre, the government's knee jerk reaction was to implement a gun amnesty, in which honest citizens had to hand in their firearms.

Many people handed in relics, museum pieces and collectables which were then allegedly crushed, whilst criminals still held onto their firearms.

The gun amnesty has done nothing to stop the criminal element from still using illegal and unregistered firearms.

Sex and drug claims rock ADF

A freedom of information application has revealed incidents of sexual assault, harrassment, drug abuse and child pornography in the Australian Defence Force.

THE Australian Defence Force has been rocked by an avalanche of fresh allegations of sex crimes and misconduct within its ranks.

About 350 pages of previously classified ADF documents have detailed allegations of rape, child pornography, filming of sexual encounters and inappropriate relationships.

The documents - released to the Seven television network under freedom of information laws - suggest years of adverse publicity about sexual misconduct in the ADF may have failed to have led to the cultural change that many had hoped for.

One of the documents reveals that in April - days after details emerged of the Skype broadcast of a sexual incident involving a female cadet at the Australian Defence Force Academy - a female soldier in Brisbane reported seeing a camera put underneath the screen of her shower cubicle.

A Defence briefing note says the case ''is considered highly sensitive given ongoing media attention to the case of female ADFA cadet. The media are unaware of this incident''.

The latest allegations come nearly two years after the start of an inquiry into into sexual abuse aboard HMAS Success.

As recently as September, an air force member was arrested and charged with seven counts of indecent assault of a minor. The case is still before the courts.

The Defence documents also reveal allegations concerning a soldier who had a 15-year-old and a 17-year-old living in Holsworthy army barracks in Sydney for two weeks.

Defence confirmed in a statement that two of its members had been disciplined over the case.

Also in September, an army member allegedly sexually assaulted a female member of his unit at Holsworthy. The matter was referred to police.

The documents reveal that a year earlier, a female student at the Defence Force School of Signals reported she had been sexually assaulted at a Melbourne hotel by a fellow student. The matter was referred to police.

In one incident on HMAS Success - allegedly four days after the first report into the sexual abuse on board the same

ship in 2009 - a crew member reported an alleged indecent assault. The incident allegedly took place last February, while the ship was in Singapore.

A sailor will face a court martial hearing over the incident, in which he or she allegedly tried to enter the room of a fellow sailor and kiss them and then allegedly grabbed the other crew member inappropriately after being pushed away.

The alleged incidents are detailed in documents labelled ''Hot Issue Briefs'' from the three arms of the forces for the past two years.

They outline incidents and responses and highlight the ''high'' media sensitivity of issues - particularly in relation to ongoing inquiries and adverse publicity about previous incidents.

The documents also detail allegations on other ships, but also in the army and air force. Some involve civilian victims.

Publicity about behaviour on HMAS Success appeared to bring forward some complaints about behaviour that had happened previously.

In one case, a senior navy officer was alleged to have had inappropriate relationships with junior sailors and allegedly had videos of sexual acts. This case is still subject to an investigation by the Defence Force Investigative Service.

In another case, there were allegations of bullying, indecent assault and a ''beer bounty'' for having sex with a victim on HMAS Toowoomba.

In some cases, complainants reactivated complaints they had dropped earlier. However, the briefs also noted that some who complained of inappropriate sexual behaviour did not want police to be notified.

A final report into HMAS Success, several reports into the culture of the Defence Force, and a separate review of more than 1000 allegations of sexual abuse are still to be completed.

In a statement last night, the Australian Defence Force said it had ''no tolerance for misconduct'' and that criminal matters were promptly reported to police.

Sexual abuse that has been going on within the ADF for decades has been swept under the carpet, by corrupt government officials often threatening the victims with ridicule, expulsion and loss of career.

Only recently by the actions of a cadet by posting his sexual exploits on the internet, that these matters have come to the attention of the masses and the corporate media.

Bullying, discrimination, sexual harassment and drugs are common within the ADF, but are genrally played down by authorities, for the sole purpose of creating the illusion that there is nothing seriuosly wrong within the higher ranks, and that all procedures are followed according to the law, which in reality they are not.

The government again is embarking on a coverup simultaneously treating the victims as criminals, and not for what they are, the real victims.

Even if any information is obtained under the Freedom of Information acts, there is no guarantee that it is given in full and not edited.

Criminals on the run after escaping detention centre

THE Melbourne immigration detention centre, which holds killers, drug dealers and failed asylum seekers, has had 25 escapees in three years.

Seventeen fugitives, including drug dealers, are still on the run.

Most were on overstayed or cancelled visas, and are awaiting deportation.

The revolving door at Maribyrnong Immigration Detention Centre has forced three internal security reviews that recommended significant changes.

Now, red-faced services provider Serco is scrambling to extend electric fences and add what immigration department officials describe as "additional anti-climb measures".

One source said changes to "soften" the centre's image after 2005, which eventually led to an electric fence replacing razor wire, meant easier escape routes.

The source said the centre was not a prison but Serco had not given staff what was needed to manage trouble-makers or felons.

"Some of these people are hard-edged. We are not talking about boat people, we are talking about people who have been in jail," the source said.

Last week the Herald Sun revealed two Vietnamese nationals who had served sentences for drug-related offences had fled the centre through the electric fence.

An Immigration Department spokesman said security improvements were under way.

After escapes between November 2010 and last January, Serco had conducted its own security review, he said.

It was followed by an outside company's assessment, and a third review by another outside company.

The spokesman said a decision was made in November to upgrade the fence, including installing another layer with a special material that makes it difficult to climb, which should be in place next month.

A Victoria Police spokeswoman said escapes were investigated by the Immigration Department but local police assisted.

Details are also logged on police databases, so if fugitives are picked up for other crimes or inquiries they can be identified by police.

"There is an offence for detainees escaping under the Immigration Act and members of Victoria Police have power of arrest under this act," she said.

AUSTRALIANS are too paranoid to admit that racism is a problem in this country, a Young Australian of the Year finalist says.

Samah Hadid, 23, a human rights activist, said Australia would not overcome the issue until it accepted there was a problem.

"I'm bewildered by the reaction when anybody suggests that there is racism in this country," she said.

"It hits a nerve and it triggers a paranoia where people say that there is no existence of racism.

"It's quite annoying, particularly being from a minority group that experiences racism."

Ms Hadid's comments come after the Herald Sun reported yesterday that respected neurosurgeon Dr Charles Teo said racism was "very much alive in Australia".

The story prompted hundreds of comments on the Herald Sun website, in a spirited debate about multiculturalism in Australia.

A Herald Sun poll last night found 83 per cent of readers agreed with Dr Teo's comments. By 5.30pm yesterday 8452 readers had voted.

The strong support for Dr Teo's comments comes as the Scanlon Foundation's Mapping Social Cohesion 2011 report says racial discrimination in Australia has grown by more than 50 per cent in the past four years.

The survey of 2000 people across the country found that 14 per cent of people last year had been victims of racial discrimination, compared with 9 per cent in 2007.

Hass Dellal, director of the Australian Multicultural Foundation, said that some people judged others on unfair stereotypes.

He said migrants and people from settled communities should interact with each other more through volunteering.

Premier Ted Baillieu said Victoria had a proud record of promoting its multicultural community, but said there were some problems.

"I don't deny, and I don't think anyone would deny, that there are in any community people with racist attitudes," he said.

Senator Kate Lundy, Parliamentary Secretary for Immigration and Multicultural Affairs, said the Federal Government had set up an anti-racism partnership with the Human Rights Commission.

AUSTRALIANS are being asked to work longer hours as bosses delay hiring new staff in the biggest jobs slowdown in two decades.

Almost 30,000 workers were turfed out of their jobs in the lead-up to Christmas, with many who kept their jobs asked to shoulder an ever-increasing burden, new data from the Australian Bureau of Statistics reveals.

"While there are less jobs around we are also working harder, with the number of hours worked rising by 0.3 per cent in December," Commsec chief economist Craig James said.

"Employers asked staff to work longer hours rather than taking on new workers."

Mr James tipped unemployment could rise to 5.7 per cent this year.

"After holding out for the past six months, Aussie businesses have finally decided to bite the bullet and start culling staff - albeit modestly."

The data came as acting Treasurer Bill Shorten tipped more jobs could be lost if conditions in Europe worsen.

"There is a tough year ahead of us in Australia (with) big challenges in the global economy, which will inevitably impact on our economy," he said.

The fall in employment in December surprised many economists who were forecasting an increase of 10,000 jobs.

Part-time workers were hit hard in the lead-up to Christmas, with 53,700 stripped of employment.

The figures showed full-time employment was up 24,500 last month. The unemployment figure actually remained stable on 5.2 per cent nationally as fewer people looked for work.

Mr James said the dour figures would force the Reserve Bank's hand for a February rate cut from the current 4.25 per cent.

Five thousand jobs were lost in the Victorian economy, although the official rate dropped from 5.5 to 5.2 per cent as fewer people looked for work.

Wilkie dumps ALP over broken pokies

Anti-pokies MP Andrew Wilkie has torn up his agreement to support the Gillard minority government after the prime minister broke her promise on gambling reforms.

Prime Minister Julia Gillard announced a watered down pokies reform plan in Melbourne on Saturday.

The decision prompted Opposition Leader Tony Abbott to label Ms Gillard the "great deceiver" for betraying Mr Wilkie and therefore becoming prime minister under false pretences.

"Nothing this prime minister says can be taken seriously ever again," he said.

"All of the promises she makes at the next election will have to be discounted, in the same way all her previous commitments have been dishonoured."

The prime minister's plan will witness a trial of the controversial mandatory pre-commitment technology to start January 1, 2013, possibly in the ACT, and if successful, then expanded.

The technology requires gamblers to preset a limit on what they are prepared to lose on high betting machines.

A decision on its roll out will be deferred until 2016.

The backdown could dent Ms Gillard's credibility but she has denied the move represented another broken promise.

"The circumstances of this parliament are clear ... there is not the support in the House of Representatives for the Andrew Wilkie plan," she said.

A devastated Mr Wilkie told reporters in Hobart he could no longer guarantee supply and confidence for the government.

He will support only motions of no-confidence in the event of serious misconduct and not support politically opportunistic motions and will consider budget measures on their merits.

"I regard the prime minister to be in breach of the written agreement she signed, leaving me no option but to honour my word and end my current relationship with her government," Mr Wilkie said.

He said the backdown was a missed opportunity but indicated he would vote for Ms Gillard's compromise.

"We should be able to trust our politicians to keep their word," he said.

"Frankly a deal is a deal."

The reforms have been the target of heavy attacks by registered clubs, which argue they will cut revenue and be a costly regulatory burden.

Key independents Tony Windsor and Rob Oakeshott had indicated publicly they would not support mandatory pre-commitment reforms.

NSW Labor backbenchers in marginal seats were coming under significant political pressure from a cashed-up opposition movement to the reforms.

Speculation was mounting last week the Wilkie promise would be dumped, in light of the government gaining an extra number on the floor of the lower house following the election of former Liberal MP Peter Slipper as Speaker.

His predecessor Harry Jenkins went to the Labor backbench.

The minority government's buffer is now just a single vote.

Mr Wilkie had wanted legislation passed by May and his 2014 deadline upheld.

Fellow anti-gambling campaigner Senator Nick Xenophon said he doubted the Gillard government had ever had its heart in the proposed gambling reforms.

"This is a breach of faith," Senator Xenophon said.

Families Minister Jenny Macklin said she had made a "substantiative offer" to Clubs ACT and had also approached the ACT government about trialling the pre-commitment technology.

She said electronic warnings will be fitted to machines and the government will also move to introduce a $250 daily withdrawal limit from ATMs in gaming venues, excluding casinos.

The Australian Greens have flagged introducing a private members bill for an alternative plan of $1 bet limits.

Greens senator Richard Di Natale told reporters in Melbourne the backdown was a sad day for families shattered by problem gambling.

"It's a spineless announcement and represents a cave in to vested interests," he said.

"It could set back the cause of pokie machine reform for decades to come."

He said the $1 bet limit policy had wider support in parliament and opposition leader Tony Abbott had not ruled out supporting the idea.

A Clubs Australia spokesman told AAP the organisation would not be "dumping" their campaign against the reforms until they examined the details of the legislation.

UPDATE 8.48am: A LIVE and lethal tiger snake and floundering freshwater turtles have joined dead penguins, a wallaby and fish washed up on Melbourne's beaches after Victoria's dirty big wet.

Summer deluges have been blamed for killing many forms of marine life as well as flushing land-based animals into Port Phillip Bay.

A live tiger snake was plucked from the sand at Williamstown beach, dead penguins have washed up at Altona and Port Melbourne while dead fish are floating off Elwood.

At Sandridge beach, which is closest to the mouth of the Yarra River and has been closed since Christmas, lifesavers have been collecting rubbish.

As well as contaminating and killing animals in and around waterways, the deluges have caused beaches to be closed and summer sporting and recreational events to be scuttled.

SuperSprint Gatorade Triathlon Series organisers said it had been a "major disappointment" they were forced to cancel the swimming leg of their competitions at St Kilda in November and again in December after EPA reports ruled the quality of the water unsafe to swim in.

"It was ridiculously disappointing for 2000 participants at both events who had to complete a running leg instead because of the quality of the water," said event marketing manager, Pierre Meneaud.

Ironically, the Dolphin Research Institute has again had to cancel its "i sea, i care" campaign, its biggest program of the year that highlights the bay's health.

Director Jeff Weir said the type of pollution pouring into the bay - silt, sediment, toxins, and household and garden chemicals - threatened its future.

"The bay is a living breathing biological filter and all the different invertebrates living on the seabed plus the seagrasses are helping keep it clean," Mr Weir said.

"But silt and sediment and toxins and debris are all smothering that natural filtering system."

The Committee for Melbourne and Shadow Environment Minister Greg Hunt have called for a Clean Up the Bay action plan to be implemented.

Mr Hunt said the plan should include a bay infrastructure plan to be delivered over a decade and an Annual Bay Day in which volunteers help clean up the beach.

"The key to Cleaning up the Bay is a Decade of Action with clear targets, actions and responsibilities," he said.

"Just as importantly though is a full community partnership which draws in both the different tiers of Government and the community."

Mr Hunt said the next step was for an initial forum, to bring together potential partners and to help set the vision for the clean-up.

Contaminated rivers and creeks pouring into the bay along with the run-off from hundreds of storm water drains should be a wake-up call to Victorians about the vulnerable state of the jewel in Victoria's crown, he said.

The EPA beach report on 36 bay sites yesterday listed 22 as poor and not suitable for swimming and 14 as fair. Not one was good.

THE State Government's road safety agency has called for a 40km/h speed limit in the CBD and busy shopping strips where pedestrians face extra danger from cars.

The Transport Accident Commission push comes after 50 pedestrians were killed in Victoria last year.

John Thompson, senior manager of road safety for the TAC, said reduced speed limits would deliver less casualty crashes in the CBD.

He said it would also be appropriate to look at speed reductions in some shopping strips.

Eric Howard, a former VicRoads road safety manager, said the state was "dragging its feet" and needed to act.

Slashing speed limits around busy suburban shopping strips and the CBDs of Melbourne, Geelong and Ballarat would save lives, he said.

"We are dragging our feet a bit in Victoria and we could get some easy gains and save some people's lives," said Mr Howard who is now co-chair of the 33,900 Australian Road Safety Collaboration - a reference to the number of people killed and seriously injured across the nation in 2010.

"At 50km/h you will probably be killed by a car, at 40 you probably won't. It must be part of making our urban centres better places."

Dr Bruce Corben, of the Monash University Accident Research Centre, said early indications from research into pedestrian road trauma showed shopping strips were dangerous places.

"Shopping strips especially in the inner-city areas, the likes of Richmond and South Yarra and Collingwood, that's where there seems to be a higher number of pedestrian injury-producing events," he said.

Tram stops, public transport hubs and areas frequented by elderly are also areas he believes "will see increased pedestrian trauma".

The Monash centre is exploring links between location and pedestrian fatalities for the last five years for the Department of Justice, TAC and VicRoads.

A spokeswoman for Roads Minister Terry Mulder said he was considering recommendations from a speed zone review by VicRoads.

The review did not consider blanket speeds of 40km/h for areas where pedestrians and vehicles frequently mix, but a spokesman yesterday indicated more variable speed limits around shopping strips were possible.

Harold Scruby, chairman of the Pedestrian Council, said speed limits should be cut to 30km/h in some spots.

Some so-called specials are even cheaper at stores where they're not on sale at all.

Prices can also differ at different outlets of the same chain.

A Public Defender post-Christmas investigation at Chadstone, Highpoint and Southland shopping centres has found bargain hunters can pay dearly if they fail to shop around.

The price of a big-screen Sony LCD television yielded the biggest difference.

It cost just $578 at Harvey Norman Chadstone while Big W offered it at the retail price of $798.

Harvey Norman Maribyrnong was $20 dearer than its counterpart on the other side of the city.

Shoppers could save almost $30 if they shopped around for a 20-piece dinner set even though the dearest outlet surveyed was selling it at 30 per cent off.

Similar legwork saved about $20 off an iron, which Kmart had cheaper than some rivals even though it wasn't even on special.

Savingsguide.com.au founder Alex Wilson said shoppers could find themselves paying too much if they failed to check whether a deal was the bargain it claimed to be. Online comparison sites could help cut the groundwork. "It's a few minutes of your time to organise yourself to potentially save hundreds of dollars," Mr Wilson said.

Choice spokeswoman Ingrid Just said it was easy to get carried away with the Boxing Day sales frenzy.

FIRST the banks tried to short-change us and now Victoria's petrol stations will play Scrooge on Christmas Day with fuel expected to leap by 14c a litre to $1.45.

Holiday road trips will cost families a whole lot more with the two big supermarket chains blamed for pumping up the price to compensate for the huge fuel discounts - up to 8c they are offering.

Motorists are being urged to fill up on Friday and Saturday when the price will average about $1.31 before a spike that is expected to last several days.

Pump prices averaged $1.37 yesterday, peaking at $1.51 in some areas.

An industry source said fuel prices should only be 3c more than the wholesale price, which sits at $1.27.

"They make it look like you are getting a good deal, but in reality you are not and just paying what the price should be," the insider said.

"There has been an artificial price because of the high discounts offered, and that's not fair."

The RACV's Michael Case said motorists were paying about 5c more for petrol compared with last year.

"The difference with filling up on Christmas Eve compared to Christmas Day or Boxing Day could be 14c," Mr Case said.

"A lot of people are on the move (over Christmas) where they use a lot of fuel so it can get quite expensive."

Mr Case said to avoid pain at the pump, motorists should monitor the fuel cycle and figure out if so-called discounts are actually a bargain.

Coles Express general manager Peter Short denied ripping off drivers.

He said an 8c discount will end on December 31.

"Our double discount fuel promotion is giving customers extra value at Christmas and helping drive their dollars further when household budgets are stretched even more than usual," Mr Short said.

Experts say the big supermarket chains have worked the discounts into their fuel prices.

But the ACCC released a report early this month that cleared the local industry of price gouging and warned the days of cheap fuel were over.

ATO wants police phone taps of criminals

THE Australian Tax Office wants the power to use police phone tap information to catch tax cheats.

The ATO is aiming to charge tax on wealth that can't be explained by people's legal income, The Advertiser reported.

But the potential for misuse of the power has been questioned by Attorney-General John Rau, who said it could only be applied on a case-by-case basis.

The ATO currently gives information to police about the tax records of suspected criminals to help bring them to justice but says the exchange should be a two-way process.

"Enabling the ATO to receive and use (police) intercept information for the purposes of raising taxation assessment would enhance the Commonwealth's ability to address unexplained wealth associated with organised crime," it has proposed to a federal parliamentary inquiry.

The inquiry is working out why a 2009 law that would allow unexplained wealth to be confiscated from suspected criminals has failed to bring any cases before the courts despite law enforcement agencies lobbying for the powers for years.

Attorney-General John Rau said there was merit in the ATO sharing police information but warned the power would have to be used cautiously.

"In general terms, data sharing between agencies can be beneficial. However, the particular circumstances of each proposal need to be examined because the devil is always in the detail," he said.

South Australian Senator Nick Xenophon, one of the first to propose legislation to confiscate wealth that cannot be explained by legal earning, cautiously welcomed the idea.

Senator Xenophon said authorities should explain why the laws appeared not to be working.

"We need to have the necessary powers to catch the bad guys without impinging on the rights of the good guys," Senator Xenophon said.

The effectiveness of the legislation has been criticised during the inquiry by many federal and state law enforcement bodies.

Police Commissioner Mal Hyde has told the inquiry the effectiveness of the wealth confiscation laws could be improved by better information sharing between state and Commonwealth agencies.

"The effectiveness of identifying unexplained wealth targets across jurisdictions to counter serious and organised crime will probably be limited unless clear mechanisms are developed and implemented to facilitate appropriate information exchange," he said.

Rapist acquitted of two charges on appeal over Lakes Entrance incident

A MAN who was convicted of raping a woman four times while he was staying with bikie friends at a Lakes Entrance motel has had a partial victory today in the Court of Appeal.

The court acquitted Steven Halamboulis, 45, of two of the rapes, which were alleged to have occurred in the motel swimming pool, after finding the evidence was "somewhat confused''.

Justices Peter Buchanan, Paul Coghlan and Peter Almond said Halamboulis was at the motel in February 2007 with friends from the Black Uhlans and the victim arrived to buy drugs.

She told a jury she was given a spiked drink and went into the swimming pool feeling dizzy when four or five men she had seen wearing black jackets with patches on the back came into the pool naked.

The appeal court said the victim's description of a man who raped her in the swimming pool did not match Halamboulis and she was badly affected by drugs and alcohol at the time.

"The inconsistencies in the complainant's version of events, the barrier to clear recollection posed by her consumption of alcohol and drugs and discrepancies (in the evidence) constituted solid obstacles,'' the court said.

The judges rejected Halamboulis's appeal against conviction on the other rape counts which occurred when the woman went into a unit to get dressed.

Hamboulis claimed he had consensual sex in the unit with the victim after she entered in her underwear and felt his genitals but the appeal court said it was not an issue at the trial whether Halamboulis believed she had consented.

Halamboulis, of Reservoir, was found guilty by a County Court jury in March last year of four counts of rape.

The appeal court reduced Halamboulis's original sentence of 10 years with a six-year minimum to six years with a minimum of four years.

He has already served over 880 days in custody.

Dad banned from asking his daughter about school

A DAD has been banned from asking his daughter, 13, about her school reports.

The Family Court also banned him from forcing her and her brother, 11, to eat all of their dinner.

The court heard that the girl has an intellectual disability, an IQ significantly below average, and is behind in her education. Her brother is a gifted student.

The mother, saying the father was in denial about their daughter's disorder, asked the court to order him not to quiz her about school reports, in order to prevent damage to her self-esteem.

In a judgment published last week, Justice Stuart Fowler ordered the dad be allowed copies of the reports, but not discuss them and her progress at school with her.

"The father is only permitted to discuss the school reports and progress of (the daughter) with the mother or the school teachers," he said.

As well as restraining him from forcing the children to eat all their food, Justice Fowler ordered that he not abuse or physically discipline the children, insist they do tasks beyond them, or smoke or drink in front of them.

Both parents were also banned from denigrating the other and from discussing their relationship breakdown in front of the children.

The court, sitting in NSW, heard that the father had spent time in jail for kidnapping a child of another relationship. It heard he suffers from bipolar disorder.

His contact with the children must be supervised by his mother or his ex-wife's mother. Justice Fowler said he made the decision in order to provide the daughter with as comfortable an atmosphere as possible.

The father has appealed.

Associates of the Comanchero outlaw motorcycle gang were sitting at Cafe Paesano in North Adelaide on Sunday night, when one of them opened fire at a man who was approaching them, police said.

Cafe Paesano part-owner Gianni Cavuoto, who went to the restaurant after the attack, believes the shooting was related to a marital dispute.

Mr Cavuoto said he was worried about patronage, but the shooting had not affected bookings.

"It's business as usual. The show goes on," Mr Cavuoto told AAP on Monday.

He said there was no damage at the restaurant, and police had taken the cafe's surveillance footage of the incident, which happened about 9.40pm.

Mr Cavuoto said the shooting could have happened anywhere but a patron of the cafe said the bikies were regulars.

Police Assistant Commissioner Grant Stevens refused to confirm whether the men exchanged gunfire, but media reports said the approaching man fired first and was shot in the leg.

Mr Stevens said the man who approached the cafe, and who was known to the Comanchero associates, fled the scene after being wounded.

He was pursued by the gunman and further shots were fired, Mr Stevens said.

SA Opposition Leader Isobel Redmond said the attack was shocking and unacceptable.

"Not only does someone come into a restaurant with a weapon, but even more (shocking is) that someone in the restaurant has a weapon and returns fire," she told journalists on Monday.

Mr Stevens said police believed the incident was connected to Thursday's shooting of Comanchero leader Vincenzo Focarelli, who remains in hospital with a gunshot wound to the leg.

But Mr Stevens denied there was an escalating war between rival bikie gangs.

"These incidents can be tracked to specific disputes in that (bikie) context, (but) this is not a bikie war where we have warring gangs, drawing lines in the sand," he told journalists on Monday.

He said the shootings, including an incident on Saturday morning when three men wearing balaclavas fired shots into a house at Burton in Adelaide's north, were isolated events.

Another lesser well known fact to the general populous , a fact well known within the office of Gillard, and her tight knit community is also supported by her self-admission, is that of her sexual orientation, i.e. being a lesbian.

Her official partner Tim Mathieson is nothing more than a farce in front of the masses. Australia’s roots in governance are that of the Judeo-Christian faith, yet the current Prime Minister serves no faith. What better way to fast track the new gay and lesbian laws than under the leadership of a lesbian Prime Minister.

The corporate media, being subservient to the governments of the day, generally steers clear of the personal topics of government leaders, whilst exposing details of Mr. Joe Average’s 15 minutes of fame in the spotlight, for whatever ground breaking story the editors see fit to print to publicly discredit the individual.

Stories of significance can be approved at the boardroom level, at the brotherhood’s lodge level, or approved by the political party’s government representatives the print media is sympathetic to.

Yet another Australian television series is in the practice of fraud, this time in renovations.

Information has been obtained from sources from within the industry that the contestants on the show renovated a dwelling. In actual fact the producers and all involved were aware that this couple could not even paint their nails let alone do any renovations to the promises, so the show’s producers hired a labour team to do the renovations for them. Naturally this was done with the utmost secrecy, in order not to expose the show’s fraud.

Many shows on Australian television involve deceptive practices, but it is the general policy not to expose these sorts of dealings, as the purpose of the shows is to generate income, in the form of advertising for the networks and their producers once they are aired.

Another real estate program has been found out to be practicing fraud, in the form of price fixing, but yet again not jail time is seen. Another bingo program was found to be fraudulent, by an ‘average’ member of the general community. It is very difficult to imagine the show’s producers were unaware of this fact, especially since it was detected by a normal person.

In the legal system many cases ‘mysteriously’ get dismissed or there is not enough evidence to prosecute the offending party, in legal procedures which are not followed by judges or magistrates.

In an insight into many cases, the judges or magistrates from traffic infringement courts all the way to the high courts of Australia are accepting bribes for lenient or dismissed sentences.

The government officials are accepting bribes ranging from notebooks to goods and services rendered at their premises in the exchange for dismissing of matters.

Legal firms are also in on it, in that they suggest to the guilty party that if they cooperate in a manner that both the legal firm and/or the presiding judge benefits, the case will be dropped.

This practice has been going on for quite some time in the courts and since some people may be ready to come out publicly, the response has been the judges are now apparently going to have their phone tapped.

This is quite ludicrous as this verbose action only warns the corrupt judges to seek alternative actions in committing the serious offence of contempt of court.

In some high profile criminal cases, police allegedly commit administrative errors, with the blessing from their superiors, to let the case slip, in essence supporting the criminal’s actions.

Further insult to injury is that the government allows the cash flow from the proceedings of crime to be kept by the allocated personnel of the crime syndicate.

What seems to the general public, as a clerical error is a well orchestrated plan by both the authorities and the legal system to let out the ‘Mr. Bigs’ of the organised crime world.

Even if the corrupt judges and police are named, they will be supported by their brethren, and the legal system, to commit further crimes.

Corey Worthington friend accused of excavator rampage

A FORMER pal of party-boy Corey Worthington is accused of causing $570,000 damage with another man after they allegedly stole a front-end loader and excavator from an industrial site and went on a destructive rampage.

Christopher Oscuro, 21, and another man who has not been charged, allegedly broke into the Coates hire site at Langwarrin South yesterday and after commandeering the machines and flattening a $65,000 work shed, they left the earth movers on fire, Melbourne Magistrates Court heard.

Mr Oscuro is also accused of leaving his car on nearby railroad tracks which was subsequently hit by a passing goods train about 4am, the court heard.

One of the ruined machines was worth $200,000 and the other was valued at $300,000, the court was told.

Also destroyed in the trail of destruction was a $5000 generator belonging to Coates, charge sheets before the court state.

Mr Oscuro, who sat in court sporting a tattoo down his left arm, had a part-time labouring job and worked nights at Coles, the court heard.

The young man was released on bail and, holding a hard hat and other possessions in a prison-issue plastic bag, raced through a TV media crew outside court.

As well as theft, arson and reckless conduct, Mr Oscuro was also charged with driving whilst disqualified.

Mr Oscuro has also been charged with using methamphetamine, or ice, as well as marijuana the day before the machinery heist at the centre of the charges.

Chief Magistrate Ian Gray described the incidents as an "extremely high seriousness of actual offending" but released Mr Oscuro on bail, on condition he live with his mother in Pakenham, abide by a 10pm to 6am curfew and report to police twice weekly.

He was told not to associate with any co-accused person in the matter and to return to court on March 1.

Mr Oscuro had a falling out with former friend Corey Worthington - who gained national attention for his nonplussed attitude in hosting a MySpace party at Narre Warren which attracted 500 riotous teenagers.

Mr Oscuro last year claimed Mr Worthington had spat on his car and attacked it with a bed post outside his house, as well as the pair having a disagreement over a girl.

Police yet to talk to burnout hoon

A HOON accused of a bridal burnout has used the cover of dark to remove his hotted-up Holdens from his home in a bid to prevent police seizing it.

The move appeared to be a bid to prevent police seizing it.

But it was a wasted effort with police admitting they could no longer impound the cars under the state’s hoon laws because they had waited too long.

“He moved the cars out at 11 o’clock last night,” neighbour Gina said.

“He had a tray truck come down and he put the red one on it and then he came back and got the white one after that.

“He’s not been home (since) … he’s done a runner.”

Gina said if police had acted when they were first given the video, "it wouldn’t have got to this and these cars would have been impounded.”

Earlier, police admit their inaction meant they are unable to strip him of his cars.

Police have 10 days from the date of an offence to seize cars under the state's hoon laws.

Eighteen days after they were first given footage of a local hoon, and 18 months after Taylors Hill residents first complained about the hoon, police are yet to speak with him or anyone else at the house.

Meanwhile, the family who gave footage of the hoon to the Herald Sun in a bid to force police to act were subjected to a frightening attack just hours after the Herald Sun was confronted by the suspected hoon on Tuesday.

A 6kg box of explosive fireworks was ignited outside their home at 11.11pm on Tuesday.

Once again the family said they had difficulty getting police to attend.

"We are all shaking," 'Gina' said.

"(It) took two phone calls to the police to get them down here and when they arrived we copped the comment, 'Oh. we thought it was just kids letting off crackers'.

"Seriously ... does that box look like crackers to you?" Gina added that it was the second box of fireworks to have been set off against their fence.

Other neighbours said hoons were active almost every day and night, with two parked cars written off in the street because of high-speed crashes.

"It's scary ... there's lots of families in the area who have little kids," Joanne Gurman said.

"Somebody will eventually get killed. I'm waiting for a car to come through my bedroom window."

Residents said their pleas for speed humps in the street to stop cars speeding at up to 100km/h had been ignored.

Caroline Springs Supt Graham Kent said police had not interviewed the driver about his behaviour.

Although it was too late to seize the cars under hoon laws, Supt Kent said the video could still be used as evidence to build a case against the man.

What seems as lack of police action, is actually the support of the criminal act.

The police are fully aware that by delaying any action, the criminals cannot be bought before the courts.

By so called inaction the police are letting the criminal free, only to terrorise more victims.

It has also been alleged that the perpetrators are harassing the victims, another non-action on the behalf of the police, to charge the persons involved.

There are many more similar examples that are not bought up by the mass media, in order not to raise the inefficiencies of the government's police force in what would be an exposé of the government not protecting its citizens.

Smugglers' sales pitch to lure refugees

ALMOST 1000 asylum seekers have arrived in 17 days, some of them expecting to be freed into the community within months.

As the latest boat arrived yesterday with 76 people aboard, it emerged smugglers had promised visas, housing and internet access.

Prime Minister Julia Gillard said the only way to stop the boats was for Opposition Leader Tony Abbott to back her plan to change the Migration Act to allow offshore processing of asylum seekers.

"We said without that power there'd be more boats," Ms Gillard told the Herald Sun.

Yesterday a Hazari detainee in the nation's newest detention centre, at Wickham Point, Darwin, said he knew the Malaysia deal had collapsed and that he expected to be given a visa.

The refugee, 21, recently arrived from Pakistan after paying people smugglers $4000 in Indonesia. He expected to be out of detention within four months and released into the community.

"The country of Malaysia is not good. If this was possible (being sent to Malaysia) then I would be back home, not in Malaysia," he said.

At Wickham asylum seekers sleep two to a room in airconditioned shipping containers.

It is believed the top three questions being asked by those who have arrived since the Government announced bridging visas last month was when will they get a visa, a house and internet access.

Refugees complained the new centre's 40 computers were not enough and four English classes were insufficient.

A Iranian engineer, 34, said he paid $15,000 to people smugglers in the Middle East and used multiple fake passports before boarding a boat in Indonesia, but he said he had been given no specific promises.

He said people smugglers offered to take him to France or Australia but he decided reaching Australia was easier.

"In my country I have a house and a car," he said. "I had one problem, I had to leave my country, some people could kill me."

Mr Abbott toured the $200 million Wickham centre yesterday and called on Prime Minister Julia Gillard to immediately reintroduce the temporary protection visas from the Howard Government.

"This would immediately mean much less of a pull factor for people currently waiting across the Indonesian archipelago," he said.

A spokesman for Immigration Minister Chris Bowen attacked the Coalition for not supporting law changes to allow the Malaysia people swap after it was struck down in the High Court.

"All the expert advice is that the Malaysia arrangement would be a genuinely effective deterrent to prevent these boat journeys," he said.

The home care industry in Australia is very lucrative as it largely exists with the help of government handouts to the business operators who are in essence placed by government heads.

Many of these business owners are cooking the books both ways, defrauding both the government and the customers. This is done in full knowledge of various authorities.

Information has been obtained from persons within the industry that home care business owners are operating fraudulently in a variety of methods.

A large auditing / accounting firm was ordered to look at the books of a few of Melbourne’s eastern suburbs home care businesses. Upon initial investigations it was found that these businesses would be shut down and their operators facing court.

Since many individuals in government support the charity industry, it was decided against the official looking into (auditing) of the businesses, purely from a business perspective.

It was also found that these businesses are employing migrant labour, predominantly Indian, for the paltry sum of $5 per hour not on the record book, to engage in domestic house chores.

Operators are also fraudulently obtaining government funds for claimed nonexistent services, as well as monies being allocated to staff is grabbed for private affairs.

These businesses predominantly operate under the multicultural banner, registered in both the eastern and western suburbs of Melbourne.

Since these people have government liaisons, they are above the law and hence prosecution.

Victoria St Richmond drug deals

Drug deals in broad daylight, with no police intervention is a common site in one of Melbourne, Victoria's well known drug hot spots, Victoria Street, Richmond / Abbotsford.

Drug deals are taking place in front of restaurants, fruit shops, in front of people including families with children.

Children are being exposed to witnessing illegal drug transactions as well as activities with no intervention of police whatsoever.

In a half an hour period, 4 drug deals were witnessed, where in one of the deals, the drug seller must have been short changed, as when he counted the monies, he shouted expletives, and became agitated.

This is not news as locals and authorities are well aware of these facts, but chose to do nothing.

Police have warned motorists that they will be out in force to catch speeding motorists (raising revenue), but when speed is sold on the streets, there are no police about.

The government has very little interest in reducing the drug trade, as it usually associates 'the scum of society' to be involved in the consumption of drugs, to which it has very little regard for their well being.

It is more profitable (officer's time vs revenue obtained) to take money from speeding motorists, than to combat the illegal drug trade.

West gate bridge no roadworks

Another scam that is quite predominant on Australian roads, is that of the roadworks lane closure, when there is no roadworks.

This picture was taken on the West gate freeway over a 5km distance where there was no works on either lanes.

In order to increase revenue via speed camera fines, the Victorian government has setup fraudulent claims that there are roadworks happening when there has actually been no works for many hours.

Sites have been independently surveyed, reveal that motorists are being slugged in so called roadworks zones having to slow down on freeways from 80km/h to a 40 km/h crawl, with no roadworks in place.

Police then nab 'speeding' motorists, in a purely revenue raising exercise, using the 'hoon' catch phrase so widely supported by the government's official propaganda machine, the corporate media.

Tough talk on Victoria's smart meters

VICTORIANS will be forced to get smart meters or risk having their power cut off if they repeatedly resist.

Householders no longer have the right to refuse to have the controversial meters installed after the State Government yesterday confirmed the roll-out would continue and declared the meters safe.

Tens of thousands of households who have already rejected the technology by deferring installations will no longer have that option.

Almost 90,000 of the more than 900,000 customers approached by installers so far have turned them away.

Energy Minister Michael O'Brien yesterday revealed the project cost was now expected to hit $2.3 billion - almost triple the original price tag.

The Baillieu Government yesterday released an audit, along with a safety and privacy impact assessment - a further $433,500 cost to taxpayers.

As revealed in the Herald Sun, the meters will be fitted to 2.6 million homes and businesses by the end of 2013 after the final review found too much money had already been spent on the scheme started by the former Labor government.

Mr O'Brien said power distribution companies, which owned the meters and had an obligation to roll them out, would treat customers "sensitively".

Government spokesman Paul Price last night said although power companies did not expect they would have to cut off people, this was an option in extreme cases.

CitiPower spokesman Hugo Armstrong said disconnecting power was a last resort.

"Nobody is going to be cut off in a hurry. The distributors are absolutely committed to working with customers to meet the Government's requirements."

There would be "extensive communication with customers" before that was considered.

The smart meter review reveals customers will not fully claw back the cost of the scheme through promised benefits such as new optional "time-of-use" tariffs that charge customers more at peak times, and restricted supply to appliances.

The review also reveals wrangling over legal liability if people on life support are remotely disconnected or fires are caused by power connection to unsafe homes.

The smart meter bill could also climb "substantially" if there were hitches with the performance of the technology and radio frequency changes.

Despite this, the Baillieu Government is forging ahead, saying it had no option after Labor's mismanagement blew out costs and allowed electricity companies to grossly overspend by up to 20 per cent.

Mr O'Brien pledged to toughen regulation so that power companies would not be able to automatically overspend in future.

The audit estimates the program will result in net costs to customers of $319 million.

Mr O'Brien, who pledged the review and dubbed the project the "myki of metering" while in Opposition and has "grieved" for suffering smart meter consumers, denied voters had been conned.

"If the report had said it was in the best interests of consumers to scrap it, we would have scrapped it," he said.

Energy Retailers Association of Australia spokesman Cameron O'Reilly supported the continued roll-out.

"While we recognise there may be some scepticism about smart meters, the technology helps customers better manage their energy use," he said.

Cops busted over cocaine party

TWO senior policemen who tested positive for cocaine the day after a work bash at a Sydney pub will be sacked.

Shane Diehm, a detective inspector, and Inspector Matthew Dennis will be dealt a "loss of confidence" motion by Commissioner Andrew Scipione and stood down.

A third officer, Australian Federal Police sky marshal Darren Kolosque also faced the sack after a separate investigation by the AFP. He has resigned.

The three were at a party on August 5 for the retirement of former detective superintendent John Alt, a respected commander who left the force last year.

Among more than 100 guests were officers from the force's Professional Standards Command which investigates police misconduct, such as drug and alcohol abuse.

Tipped off about the trio's activities a day after the function, NSW Police and the AFP arranged for drug tests. Inspectors Diehm and Dennis were investigated but refused to "make admissions" on where they acquired the cocaine or how much they had consumed.

The test on Insp Diehm, who was crime manager at Tweed-Byron Local Area Command, returned higher traces of the drug. The Sunday Telegraph understands neither Insp Dennis, who was at Hunter Valley Local Area Command, nor Insp Diehm will face criminal charges.

A senior police source told The Sunday Telegraph this was because the drugs had been consumed and there was no criminal charge that could be applied.

A separate inquiry by the Police Integrity Commission is investigating an alleged conversation about securing a medical payout through the police death and disability scheme instead of being sacked.

The scheme is currently the subject of controversy after changes were made by the NSW Government preventing officers from manipulating the system.

Days after the Paddington function, Insp Diehm was called to a meeting with PSC officers and suspended on full pay. And Insp Dennis, who was driving to the Snowy Mountains for a holiday, was called and asked to pull into Queanbeyan police station for a drug-test.

Agent Kolosque, a former NSW policeman and recipient of a bravery award, is understood to have confessed when quizzed by AFP investigators.

In this article it states that a police head is well respected, where in reality there is no evidence that can implicate an individual.

In many 'well respected' law firm known to corpau, there are senior members that frequently engage in the consumption of drugs, but they are not prosecuted.

The illegal drug trade in Australia is worth $1,200 million per month), in which many bribes are paid to officials, police, judges and others for the drug trade to continue, which it always will.

There was no mention in the article of incarcerating the (known to police) supplier of the drugs, or the lab from where they came from.

Corruption in the police force is rife.

Odds in favour of illegal immigrants

THE odds are stacked in favour of unlawful immigrants who want to call Australia home - there is less than one chance in 23 they will be caught.

Of the 58,400 hiding in the community, only 2500 were tracked down in 2010-11, a Herald Sun investigation has found.

And they are arriving faster than they are being caught, with 10,600 more living here now than six years ago, easily outstripping the 4700 refugees in detention.

The Department of Immigration and Citizenship declined to tell the Herald Sun how it tracked down unlawful immigrants it did catch, saying the information was "not readily available".

But it acknowledged most unlawful non-citizens handed themselves in and most of the rest were caught only after public "dob-ins".

The Herald Sun last month revealed more than half the foreign citizens living here unlawfully had called Australia home for five or more years - 20,000 for a decade or longer.

The Ethnic Communities Council of Victoria's new chairman, Joe Caputo, said the figures showed the disproportionate amount of resources spent on asylum seekers who arrived by boat.

"It's absurd. It's a huge, huge cost," he said.

"We spend far too much time and resources with a small number of people and yet we have this other huge area that has almost gone unattended."

Mr Caputo said that by taking jobs and housing, using public services without paying tax and often being involved in dubious activities, unlawful immigrants harmed the wider community and sullied the reputation of genuine migrants and refugees.

Many created bogus identities or engaged in criminal activities to survive, and police provided 302 tip-offs to immigration officials in 2010-11. Another 73 tips came from other agencies, such as Centrelink, and 10 from local government.

But most of the 2504 tracked down were found after being dobbed in by family, friends, workmates or concerned citizens.

An Immigration Department spokeswoman said there were 6109 tip-offs from the public about unlawful immigrants in 2010-11.

"The majority of dob-ins are anonymous and ... not all would lead to the department locating an unlawful non-citizen," she said.

The department also received "internal dob-ins" from its officers. In 2010-11, 846 internal dob-ins were received from Immigration staff in Australia, with a further 124 from offshore.

The department spokeswoman declined to say how many tip-offs or "internal dob-ins" led to arrests.

A total of 13,831 unlawful non-citizens returned home in 2010-11, 338 fewer than the previous year.

Of those, 11,327 handed themselves in, usually after short-term visa overstays or minor visa breaches. Most were given bridging visas before making their own way home.

Spring St set to cash in with pay rises

BIG pay rises mooted for federal politicians will flow through to State MPs next year.

Under Victorian law, pay for state MPs is based on that given to their federal colleagues, minus $5733.

That increase was limited this year to 2.5 per cent, but that cap is only in place until July 1 next year.

The Parliamentary Salaries and Superannuation Act refers to this as a “temporary limit”.

A backbencher who earns $131,000 a year could end up raking in about $175,000.

Premier Ted Baillieu would see his salary rise from $317,730 to about $350,000.

Greens MP Greg Barber said Mr Baillieu needed to decide what would happen with politicians’ salaries from next year.

“He’s got until June 30 next year to decide what he is going to do,” Mr Barber said.

“As soon as we get until June 30 next year, the previous, and any mooted pay rises, will kick in, in full.”

Mr Baillieu would not say how future pay rises would be determined.

“We’ve legislated a 2.5 per cent increase,” Mr Baillieu said.

“We don’t have a change in front of us at the moment.”

The Baillieu Government imposed a 2.5 per cent cap on rises this year, in line with its base offer to public servants, nurses and police.

At the quite verbal disgust of the masses, they have given themselves a pay rise of anything between 30 - 50%, whilst the rest of the general population struggles to achieve the official inflation rate (3.52%) pay rise from their employers.

During this economic climate the politicians are quite loudly touting that during these 'difficult economic times', ' "we" must tighten our belts', quite clearly excluding themselves from any such actions.

Whilst the politicians are getting fatter and fatter, the rest of the general populous are being pushed into poverty.

Judges to face phone taps

JUDGES, magistrates and vice-regal officers will be subject to phone tapping surveillance and Royal Commission-like investigation under unprecedented new powers to be handed to Victoria's first Independent Broad-based Anti-Corruption Commission.

Members of the judiciary will also be compelled to give evidence, have their premises searched, computers monitored and assets seized under sweeping changes to Victorian law developed specifically for the new corruption-busting watchdog.

Vice-regal figures, such as the governor, will also be subject to the tough new coercive powers aimed at stamping out dishonest dealings and unscrupulous behaviour in the public service.

It will be the first time

the judiciary has been subject to such scrutiny, opening the door for the use of surveillance devices and telephone bugging equipment to observe, listen to, track and monitor suspected corruption in the courtroom.

Law Institute of Victoria president Caroline Counsel said the changes went too far, branding the move an "inappropriate leap".

"There is no evidence of any sort of systematic corruption in Victoria so you wonder are we in fact making a really big cannon to shoot a fly," she said.

"At the moment there is really nothing to justify this."

The Government will introduce the legislation in State Parliament this week.

Past judges could also come under scrutiny with IBAC to be equipped with retrospective powers to probe historic corruption allegations.

A senior government source said the hard-hitting changes were what Victorians had voted for in the hope of flushing out state secrecy.

"This legislation is further proof of just how serious the Government is about fighting corruption," he said.

The commission, and its yet-to-be appointed commissioner, will be accountable to a new joint parliamentary committee and an inspector hired to watch the watchdog.

A spokeswoman for Supreme Court chief justice Marilyn Warren, Anne Stanford, declined to comment.

Margaret River bushfire declared a natural disaster

UPDATE 4.20pm: Insurers estimate the damage from the bushfires in Western Australia's Margaret River region will be in the tens of millions of dollars.

Insurance Council of Australia chief executive Rob Whelan said the industry was encouraged that the fires had been brought under control.

"We're still getting a picture of the extent of the damage but very early estimates put the damage in the tens of millions of dollars," Mr Whelan said in a statement on Monday.

Mr Whelan said the council had sent a senior manager to the area to work closely with state and local government authorities as the recovery process commenced.

Thee bushfire has been declared a natural disaster, triggering extra funding from the state and federal governments.

About 40 firefighters continued mopping up around the fire on Monday but it is no longer considered a threat to lives or properties, after destroying 32 homes on Wednesday and Thursday.

Hundreds of residents have returned to their homes after evacuating when a prescribed burn in a national park escaped and tore into bushy subdivisions.

The West Australian government is copping flak over the fire, which was started by the Department of Environment and Conservation (DEC) in September and reignited on Monday last week.

The state opposition has called for Environment Minister Bill Marmion to be sacked but Premier Colin Barnett says the fire was an accident and blame should not be laid.

Mr Barnett declared the fire a state natural disaster on Monday, which means recovery grants of up to $15,000 can go to primary producers and small businesses who suffered loss.

He said he had written to Prime Minister Julia Gillard seeking agreement to implement the grants, with equal contributions from the WA and federal governments.

The WA government has already announced that families who lost houses can get $3000 emergency assistance grants, while those whose houses suffered damage can get $1000.

Mr Barnett said his sympathies went out to those who had lost their homes and he thanked firefighters for their efforts in saving so many houses.

DEC's Director-General Keiran McNamara has defended the burn, saying unseasonal wet weather prevented it being completed in the time expected but it needed to be reignited to ensure it burnt out.

The DEC says 32 houses, nine holiday chalets and five sheds were lost in the blaze, while 22 houses and a shop were damaged at Prevelly, Gnarabup and Redgate.

Wallcliffe House, an 1865 riverside manor being restored by Woodside Petroleum and National Australia Bank chairman Michael Chaney, was one of the houses destroyed by the fire.

QUEENSLAND MPs have voted in favour of legalising same-sex civil unions during an historic night in Parliament.

After almost four hours of debate Andrew Fraser's private member's bill was passed by a vote of 47 to 40, the Courier-Mail reported.

The bill, introduced by Deputy Premier Andrew Fraser, enables same-sex couples to register their union with the Queensland Registry of Births, Deaths and Marriages.

The bill will grant same-sex couples the right to enter in to legally recognised civil unions. It prompted a strong reaction from gay rights, religious and family groups.

Labor MPs were allowed a conscience vote, but the Liberal National Party indicated it would vote en bloc against the bill.

Speaking in Parliament, Mr Fraser said it was 21 years to the day that Labor decriminalised homosexual activities in Queensland. And now he said, Labor could make history again to progress the rights of homosexuals.

"This bill merely but not meekly seeks to formally recognise relationships which have existed in Queensland for centuries,'' he told Parliament.

"It provides them with the opportunity to celebrate their commitment and their love for one another in a ceremony in front of friends and family, perhaps this is its most important feature.''

Opposition legal affairs spokesman Jarrod Bleijie said Mr Fraser only introduced the bill to shore up the left vote and was rushing it through parliament before the election, due early next year.

He said the bill was only introduced on October 25 and there has not been enough time for community consultation.

"He (Mr Fraser) did it to stich up a Green preference deal,'' Mr Bleijie told Parliament. "This bill is nothing more than a stunt.''

Mr Bleijie said more than 54 per cent of the final number of submissions to a legislative committee that examined the bill were received 17 days after the cut-off date.

"That goes to the heart of the lack of consultation,'' he said.

"We do not believe the people of Queensland have had the appropriate opportunities to raise their concerns.''

He also said the bill was not a priority for Queenslanders, who are more concerned about cost of living pressures.

"Civil partnerships is not on a priority list in the minds of Queenslanders,'' he said.

"The passing of this bill will not save Queenslanders money, it will not ease cost of living pressures, it will not get our triple-A credit rating back.''

Premier Anna Bligh said the bill may not be a priority for all of Queensland but it was a priority for those that live with discrimination every single day of their lives.

"The fight against discrimination should be a priority of any government,'' she told Parliament.

"This bill is fundamentally about the human rights of Queensland's citizens, but it is much more than that, it is about the joyful business of love and that is why it has touched the hearts of so many Australians, why so many people believe that Australia should be dealing with this issue.''

She also attacked the LNP for not having a conscience vote.

"They are now in the grip of the rising influence of the religious right,'' she said.

Capalaba MP Michael Choi became the first Labor member to speak against the bill. If six Labor MPs oppose the bill it is not expected to pass.

Mr Choi said he had voted in Parliament to give homosexuals the same rights as heterosexuals when it came to taxes and property law and would continue to do so.

But he said he was brought up in a conservative household and when it came to legislating on homosexual love, his conscience didn't agree.

"I struggled and I argued with myself over and over but in the end I could not support this bill,'' he told Parliament.

"My conscience does not allow me to go further, I wanted to but I could not. To those I have disappointed and hurt with my decision I am sorry.

"I must be true to my own conscience because I have to live with me.''

He said he also doesn't support the legislation because it would only be recognised in Queensland.

"The real challenge is with Federal Parliament, because that is where the challenge lies,'' he said.

Labor MP for Toowoomba North Kerry Shine had said this week he was undecided on whether he would support the bill, but told Parliament he would vote in favour of it.

Gladstone independent MP Liz Cunningham said she will vote against it.

Independent member for Nanango Dorothy Pratt said she would also vote against the bill.

Not only did she believe the legislation was being rushed through, she believed it could be seen to erode Christian values.

She said she had received hate mail over her opinion, and had been called ignorant, coming from the dark ages, and even old and ugly. But that would not deter her.

"I accept that the homosexual community see this as a human rights issue,'' she told reporters.

"But I also accept the fact that many people of religious belief believe that this is an issue about marriage, they believe it is a dilution of their belief that marriage is between a man and woman, and I also believe that they believe it endeavours to remove a basic tenet of their life.''

Health Minister Geoff Wilson said although he had publicly supported the bill, he had decided only in the past few days to oppose it.

He said that his working class and Christian background have been the pillars of his life and he felt uncomfortable that the bill created a new legally recognised relationship that was an alternative to marriage.

"I am not convinced that that is a good thing to do,'' he told Parliament.

"I believe in the biblical understanding of marriage. I have wrestled with the many issues involved in the bill and have tried to bring an open mind.

"This is a conscience vote and I feel bound to vote with my conscience,'' Mr Wilson said.

Member for Albert Margaret Keech was the third Labor MP to speak against the bill.

She said she was a Christian and that civil unions mirror marriage in all but name and undermine the institution.

"I believe that marriage is between a man and a women ... therefore after careful consideration my conscience prompts me to oppose this bill by voting against it,'' she told parliament.

"I do not support a radical change to the long-established definition of marriage.

"I am not convinced that any change to marriage is for the common good for our society.''

She also said the vast majority of constituents she spoke to didn't want her to vote in favour of the bill.

Earlier, a crowd of gay rights activists gathered outside Parliament in a last ditch bid to urge MPs to support the bill.

One of the activists, Alex Myman, said her message was simple.

"We want equal rights," she said. "We're human beings as well."

Premier Anna Bligh addressed the crowd and said she looked forward to a "majority of voices" supporting the bill in Parliament.

She dismissed claims from her political opponents that the main issue was one of "process".

"This is not about process, this is about human beings," she said. "It's about Queenslanders and it's about their human rights."

The crowd dispersed ahead of the start of debate.

With Independent Rob Messenger suspended from the house and the remaining six independent and minor party MPs expected to oppose the bill, the legislation requires as few six government MPs to abstain or vote "no" to be defeated.

Earlier today Mr Fraser urged the Opposition to vote with their consciences on the bill.

AUSTRALIA has enough illegal immigrants on the loose to populate a large regional city.

A Herald Sun investigation has found that nearly 60,000 people - one in every 390 - is in the country unlawfully, sparking renewed calls for a crackdown.

The 58,400 foreign citizens hiding illegally among us easily outnumber the populations of Mildura or Shepparton - Victoria's fifth and sixth biggest cities.

And they dwarf the 4700 asylum seekers who arrived by boat in 2010-11.

Documents released to the Herald Sun under Freedom of Information also reveal the biggest groups of illegals are Chinese, Americans, Malaysians, Britons and South Koreans.

More than half have been here for five or more years; 20,000 for a decade or more; and two in three have evaded authorities for more than two years. (The figures do not include visitors who overstay visas by less than a fortnight.)

Ethnic Communities Council of Victoria chairman Sam Afra said illegal residents attracted little of the outrage associated with boat people, despite taking jobs and housing, using public services, and not paying tax.

He said it was far too easy to stay here if you knew how to "work the system".

"It's shocking," he said.

"To have one in three who have been here more than 10 years (suggests) something's wrong with the system."

"Nobody's talking about it. It is a problem, and the question is, don't you think the damage justifies putting more resources in (to find them)?"

He said the involvement of illegals in criminal and other dubious activities also sullied the reputations of legal migrants.

Jailed terrorist cell leader Abdul Benbrika lived illegally for years after arriving on a visitor's visa in 1989. Three months after marrying in 1992, while still an illegal, he successfully applied to stay, living on welfare with his wife and seven children until his arrest in 2005.

Illegal immigrants have also been involved in drug cartels, sexual slavery, and fraud. Illegals accused of guarding marijuana crops in Melbourne and regional Victoria were among 43 people arrested last year in raids focusing on a $400 million crime syndicate.

A charter flight to deport 76 illegal aliens from Malaysia and Indonesia, busted picking fruit in Mooroopna last year, cost taxpayers $100,000.

Australian Human Rights Commission president Catherine Branson, QC, said it was important to remember many more overstayed visas, or arrived by plane and sought asylum, than arrived by boat.

"Another misconception is that people who arrive by boat are illegal immigrants. Australia is obliged to assess asylum seekers' claims."

There were 10,600 more illegals at June 30 last year than in 2005.

Australia will be inundated with cheap ethnic labour which is supported by both government and the business community.

The excuse given to the masses, propagated by the mass media networks, which are puppets of the government, is that of 'Human Rights', so that there will be no opposition to the corporate slave setup by the governments.

Watchdog slams State over poor response to deadly Hendra virus

QUEENSLAND'S Ombudsman has found systematic failures in the State Government's handling of Hendra virus outbreaks.

In a scathing report released Thursday morning, Ombudsman Phil Clarke found policies and procedures were outdated, quarantine practices were inconsistent and there was inadequate communication with vets and horse owners.

The Government had also failed to implement recommendations from previous internal and external reports and did not properly strain staff, contractors and property owners.

That hampered the way government agencies could respond, he found.

The report focused on the handling of six Hendra incidents between 2006 and 2009, but did not consider more recent outbreaks.

"While much work has been done by the agencies concerned and the response systems are rapidly maturing, more needs to be done as a matter of priority before the next Hendra incident," Mr Clarke said.

He also found decision-making was not properly recorded and there was inadequate framework to arrange compensation.

Mr Clarke made 74 recommendations to improve the response.

His two-year investigation largely centred on Queensland Primary Industries and Fisheries, Queensland Health and Workplace Health and Safety Queensland.

Refugee intake should increase by 50 per cent, Immigration Minister says

UPDATE 11.07am: THE Opposition says a proposal by Immigration Minister Chris Bowen to increase the refugee intake by 50 per cent would cost the government $1.35 billion over four years.

Mr Bowen will propose at the Labor Party's national conference this weekend to increase Australia's resettlement of refugees from 13,750 to 20,000.

"I have had the view for some time that we could and should take more refugees," Mr Bowen told ABC Radio.

"It's an aspiration ... there's no timeline that I'm putting on it," he said.

"I just think it's very important that the Labor platform, which is after all a statement of broad objectives, has that objective in it for the first time."

Immigration spokesman Scott Morrison said the proposal would cost the government $1.35 billion over four years.

"He wants to increase the refugee intake each year," Mr Morrison told Macquarie Radio.

"He wants to do this deal with the Labor left to get support for his already failed Malaysian people swap."

Mr Morrison said the government was capitulating to the Greens.

"More and more people are getting on each individual boat at the moment, which is increasing the risk for those people...

"This minister has simply lost control."

Liberal MP Kelly O'Dwyer said lifting the refugee intake was another Greens policy Labor was keen to introduce.

"(And) it's the policy of distraction," she told Sky News.

"It's something they said they were going to fix, they haven't fixed it, now they're looking to the next issue."

Mr Bowen said Australia's refugees intake was the highest per person of any country in the world.

"But that doesn't mean I don't think we can do more still," he said.

He said his proposal would make it clear that Labor's view was to take more refugees.

"We want to give more people a life in Australia but we need to tackle the dangerous boats coming to Australia," Mr Bowen said.

"Then we can have that conversation with the people of Australia to increase our refugee intake further."

Mr Bowen said the offshore processing of refugees had to be one of several measures to reduce the number of people jumping onto boats heading to Australia.

"Just increasing your refugee intake is not a deterrent to getting on a boat to come to Australia, but if it is part of a broader mix, which included offshore processing, that would be important," he said.

Labor abandoned a plan to put its bill to allow offshore processing of asylum seekers in Malaysia to a vote in October after it could not guarantee its passage through parliament.

The minister's proposal comes after Australian authorities intercepted a boat carrying more than 100 asylum seekers east of Christmas Island on Wednesday.

An Android app developer has published what he says is conclusive proof that millions of smartphones are secretly monitoring the key presses, geographic locations, and received messages of its users.

In a YouTube video posted on Monday, Trevor Eckhart showed how software from a Silicon Valley company known as Carrier IQ recorded in real time the keys he pressed into a stock EVO handset, which he had reset to factory settings just prior to the demonstration. Using a packet sniffer while his device was in airplane mode, he demonstrated how each numeric tap and every received text message is logged by the software.

Ironically, he says, the Carrier IQ software recorded the “hello world” dispatch even before it was displayed on his handset.

Eckhart then connected the device to a Wi-Fi network and pointed his browser at Google. Even though he denied the search giant's request that he share his physical location, the Carrier IQ software recorded it. The secret app then recorded the precise input of his search query – again, “hello world” – even though he typed it into a page that uses the SSL, or secure sockets layer, protocol to encrypt data sent between the device and the servers.

“We can see that Carrier IQ is querying these strings over my wireless network [with] no 3G connectivity and it is reading HTTPS,” the 25-year-old Eckhart says.

The video was posted four days after Carrier IQ withdrew legal threats against Eckhart for calling its software a “rootkit.” The Connecticut-based programmer said the characterization is accurate because the software is designed to obscure its presence by bypassing typical operating-system functions.

In an interview last week, Carrier IQ VP of Marketing Andrew Coward rejected claims the software posed a privacy threat because it never captured key presses.

“Our technology is not real time,” he said at the time. "It's not constantly reporting back. It's gathering information up and is usually transmitted in small doses.”

Coward went on to say that Carrier IQ was a diagnostic tool designed to give network carriers and device manufacturers detailed information about the causes of dropped calls and other performance issues.

Eckhart said he chose the HTC phone purely for demonstration purposes. Blackberrys, other Android-powered handsets, and smartphones from Nokia contain the same snooping software, he claims.

The 17-minute video concluded with questions, including: “Why does SMSNotify get called and show to be dispatching text messages to [Carrier IQ]?” and “Why is my browser data being read, especially HTTPS on my Wi-Fi?”

The Register has put the same questions to Carrier IQ, and will update this post if the company responds. ®

More than 19 hours after this post was first published, Carrier IQ representatives have yet to respond to a request for comment. Meanwhile, computer scientists have uncovered anunrelated Android glitch that could also invade smartphone users' privacy.

Former Tas MP avoids jail over child sex

A former Tasmanian MP has dodged an immediate jail term after being found guilty of having sex with a 12-year-old.

Terry Martin, 54, was last week found guilty of unlawful sexual intercourse with a person under 17 and of producing child exploitation material.

On Tuesday, Justice David Porter sentenced Martin to 10 months in jail, wholly suspended, the ABC reports.

Judge Porter linked Martin's offending to medication for Parkinson's disease which triggered hypersexual desire, the report said.

Martin, a former MLC and Glenorchy mayor, responded to an advertisement for adult sexual services in 2009 placed by the girl's mother and a pimp.

He paid the girl $600 to perform sex acts and also photographed them.

Martin denied the charges on the grounds that he thought the girl was 18.

AN eight-year-old American boy, who weighs more than 90kg, has been taken from his family and placed into foster care after social workers said his mother wasn't doing enough to control his weight.

The Plain Dealer newspaper reports the Cleveland boy is considered severely obese and at risk from such diseases as diabetes and hypertension.

The case is the first state officials can recall of a child being put in foster care strictly for a weight-related issue.

Lawyers for the mother say the county overreacted when authorities took the boy last week, saying the medical problems he's at risk of developing don't yet pose an imminent danger.

THE State Government has sought a briefing on possible legal ramifications for speeding fines after a policewoman beat one of Melbourne's most hated speed cameras.

Rosebud Senior Constable Faye Pitman used the evidence of a 16-year-old work experience student to raise enough doubt that she had been travelling at the clocked speed of 106 km/h along the notorious EastLink stretch.

The EastLink cameras have angered scores of drivers who claim they have been unfairly fined.

But until yesterday no one managed to have an infringement overturned.

Sen-Constable Pitman, a 20-year police officer, was in tears after the charge was dismissed.

The crucial evidence came from high school student Erin McKernan, who was in the police car at the time on work experience.

Ms McKernan, now 18, told the court she looked at the car's speedometer just before reaching the Dandenong bypass, where the camera was mounted.

She said the marked police car had been travelling at 95-96 km/h. Sen-Constable Pitman said she had been doing 98km/h.

Magistrate Gerard Bryant threw out the case, despite prosecutor Rob Taylor's argument that tests on the speed camera showed it was accurate and that evidence from Sen-Constable Pitman was "slight and unconvincing".

Police Association secretary Greg Davies said the decision to dismiss the fine could open avenues for other drivers.

Legal experts agreed the surprise victory could open the floodgates.

Prosecutors have not ruled out an appeal, but the Herald Sun believes it is unlikely.

Police Minister Peter Ryan was on the back foot last night.

"In light of today's ruling, I have sought a briefing from Victoria Police and the Department of Justice as to how this decision relates to the current legislative framework," he said.

Legal experts and police officers said the case would be a launching pad for others.

"This could open Pandora's Box for everyone else," one officer said.

Barrister and traffic law expert Michael Kuzilny said it would have significant ramifications.

"It's a really great thing. Previously, it has been impossible for people to prove that they weren't speeding," he said.

"It means there will be a floodgate opening of people challenging, and many, many more people and angry drivers questioning their fines."

Barrister Theo Alexander said the decision would likely "embolden many motorists who have been charged in similar circumstances to challenge their speeding fine".

A colleague said Sen-Constable Pitman was regarded as a careful driver who did not speed.

"She's like Driving Miss Daisy - that's why everyone's been on her side."

In Victoria the Premier of the day, Jeff Kennett helped set up a Melbourne casino, where many crime deals have occurred, and subsequently the authorities support this money laundering business.

Gambling venues have been involved in a money laundering fraud, which involves the faking of attendees for quite some time.

CCTV cameras record the traffic, and compulsory registration of patrons coming into the venue, either for a club lunch or drinks. The gambling venue uses this information to ‘cook the books ‘, that these patrons were gambling, and in effect launder the illicit drug money.

This practice is known to authorities, but is deliberately overlooked, as these premised are employment providers, and the business owners are cronies of the politicians, law makers and others highly placed in the business community.

The newly elected Victorian police head claims that in his sights, corruption and crime will be on the list. Many are aware that corrupt police are on the payroll of well established drug gangs. Since the drug industry in Australia is worth an approximate $1.2 billion per month, there is plenty of funds to supply corrupt persons.

Family forced to move after suffering health problems

A SMART meter health scare has driven residents from their homes amid fears they are being exposed to high levels of electromagnetic radiation.

A young family and another resident have fled the Keilor East street, claiming constant headaches and sleep deprivation is making their lives a misery, but authorities say the controversial devices are safe.

Marc and Maureen Florio, who have been staying with friends since Friday, said they and their four children had suffered side-effects since a neighbour's smart meter was installed three weeks ago.

Tests found radio frequency emissions more than 30 times stronger than "precautionary levels" in their 14-year-old son's bedroom and high levels elsewhere. All readings were within Australian standards.

"It's like an absolute nightmare," Ms Florio said.

"I do not know what we are going to do ... we are smart meter refugees."

Mr Florio said a doctor attributed constant headaches to the meter. He and his eldest son are also sensitive to other emissions.

"We are not after compensation," he said. "We just want it switched off."

Kathi Buzza, who had the meter installed, also wants the device gone.

YSHIELD general manager David Mould, who tested the Florios' house, recommended the smart meter be removed.

He said while readings were within Australian standards some people appeared sensitive to weaker emissions and he recommend lower levels as per European guidelines.

Power company Jemena said tests of the meter and another across the road had shown no problems. Other residents had not expressed health concerns.

The Baillieu Government has ordered independent checks to allay concerns about potential health risks from smart meters.

A spokesman for the Energy Minister said testing so far showed they had complied with standards and emitted weaker electromagnetic emissions than other sources such as baby monitors and mobile phones.

The jury's annual media campaign targets food companies which advertise their products to children.

Mother-of-two and jury member Natalie Wischer slammed Warne's involvement with McDonald's and said there was no place for junk-food advertising in sport.

"I am disappointed Shane Warne, who is such a role model to kids like mine, has chosen to be associated with McDonald's," Ms Wischer said.

The group of health-conscious parents said Kellogg's used dishonest advertising to promote sugar-laden cereal.

Kellogg's Nutri-Grain cereal, marketed as an energy-packed breakfast for boys training as ironmen, has been named the most shady advertising campaign by The Parents' Jury.

Jury manager Corrina Langelaan said the aim of the group was to fight back against the marketing techniques of the food industry.

"The industry may be getting smarter about getting around its self-regulatory code, but parents tell us they are fed up with unhealthy food advertisements being shown during their kids' favourite (TV) programs," Ms Langelaan said.

Kellogg's said in a statement it has made "significant changes to the way we work" in recent years.

"We now focus much of our efforts on promoting healthier cereals such as Sultana Bran, Mini Wheats, Just Right and All Bran," the statement said.

"Our advertising is aimed at parents so that they can make informed choices about the best foods for their family."

Inquiry hangs over former Victoria Police detective Bill Nash

A FORMER Victoria Police detective has been under investigation for three years over a story published in the Herald Sun.

Former detective senior sergeant Bill Nash said his career remained tarnished by corruption authority inquiries over the leak.

Mr Nash was assigned in 2003 to review a police taskforce investigation into Denis Tanner, a former police officer suspected of murdering his sister-in-law, Jennifer Tanner, and transsexual prostitute, Adele Bailey.

He found taskforce head Insp Paul Newman and Sen-Sgt Marty Allison should have been charged with attempting to pervert the course of justice, concluding they dishonestly strengthened their case against Denis Tanner in a number of listening-device and telephone-intercept affidavits. Neither was charged.

When part of his report concerning non-prosecution of the case was published in the Herald Sun in 2008, Mr Nash said he became the subject of an investigation, which remains unresolved.

He said he did not leak the information to the paper but the damage had been done.

Mr Nash said he had kept the victims, who were former police members, fully updated on the progress of the investigation.

He said this was done to ensure the alleged victims did not accuse the force of a whitewash of the matter.

"It was provided as feedback under the Victim's Charter," Mr Nash said.

The information was later published.

Mr Nash said he was disgusted at not having received his certificate of service because of the probe, which he said should have been sorted out either way by now.

A Victoria Police spokeswoman would not comment as it was a "personnel matter".

Overland was given the position, after his predecessor, Christine Nixon, was given the tile of Top (female) Dog, without the qualifications or experience necessary, giving the phrase ‘Money for Mates’ credibility.

She left under disgraceful circumstances, when the state of Victoria was under emergency, during the bushfires, she nonchalantly disregarded her role, attending a formal function, whilst the emergency services, including the police were working overtime.

The Herald Sun has published his weak educational achievements, which consist of a Diploma in Police Studies, together with a Bachelor of Arts.

Organised crime, which includes the drug gangs is a large contributor to other crimes committed. The industry is worth an approximate $1.2 billion per month, yet the news media rarely reports on $200 million dollar drug hauls, which should happen on a weekly basis, and not on monthly or two monthly cycles.

Australia’s banking community is largely referred to as the “Big 4”, meaning the large four banks. The profits they post, can range from $4-5 billion annually for each of the banks.

Banks are in the business of making money from your money, but there are other methods in which revenue is gained, which the majority of the population may not be aware of.

An essential part of the business plan of the banks is something called the Mortgagee’s Auction. A mortgagee’s auction is when the lender is no longer able to meet the banks monthly repayments, which results in the bank taking possession of their property, and recovering the costs of the balance of the loan.

Banks are involved in a large scale land grab fraud against consumer, a fact which is curiously out of the media spot light.

Banks have figured out a while ago that one of the easiest ways of obtaining cheap property is for customers to default on their loans, allowing the banks to grab the property (legally), and pass it on to their employees in another fraud.

Many Australian’s have lost their home through this fraudulent practice, which has not been stopped by law, a deliberate move to the detriment of the community

Given a customer’s earnings, the banks allow a certain amount to be borrowed based on a formula that indicates that the customer can not only successfully service the loan, but also is able to sustain themselves financially within the community.

Banks have done away with this model of business practice, and now offer loans to clients, that are not able to service them. The banks knowing this fact, wait for the customer to default on the loan within a certain amount of years, collect the property at a fraction of it real market value.

When lending out to domestic clients, the loan procedure passes through three stages of approval before it makes it to one of the manager.

In a recent matter, one of the ‘Big 4’ banks approved a home loan of an elderly person, which could result in their home being sold from under them, unbeknown to themselves.

This matter is currently in the hand of a high profile Australian law firm.

Naturally the bank will never be charged with fraud.

Government Water fraud cover-up

The Australian government is involved in a multi-billion dollar fraud, falsified water figures, and money for mates contract deals that is being covered up, and ‘overlooked’ by mass media agencies.

The government has been caught out providing fraudulent information, regarding the crime statistics in Victoria, and as a result the disgraced Police head Simon Overland resigned as top dog. No further news to the masses has been given into any convictions of fraud or any other criminal activities of Mr. Overland.

There are many other government cover ups of fraud that the media does not report on.

In the eastern southern state of Australia, Victoria and its capital city of Melbourne has seen heavy rainfall for approximately the last two years, in which there also occurred floods.

Information obtained from various sources indicates that the government has falsified water storage facility levels, over many years in order to justify the business case for building a desalination plant, simultaneously exponentially raising the price of water, whilst pushing the blame on ‘the drought’, an event which is beyond the control of governments.

The government has deliberately prepared an environment, in which there was to be a lack of water, which would necessitate the need to build a desal plant, at the expense of the taxpayer.

Town planning, roads, and water storage facilities in Victoria have been handled by a government institution called the MMBW (Melbourne and Metropolitan Board of Works), which was also responsible for the building of dams that catered for the rising population.

Since the global policy is for all government and public utilities to be held in private hands, Victoria’s water utility has been sold.

Since the sale of this utility, there has been no expansion of infrastructure, even though there has been a rise of approximately 30% in population over the past generation, in Melbourne.

In every decade there exists a mini drought, as well as wet periods. These events are cyclic and also follow 50 and 100 year patterns, a fact which is well known to authorities.

The majority of the masses are not well educated in these matters, and the government has taken advantage of this, by promoting via the mass media that we are in a drought, at the same time building car washes.

Soon after the infrastructure has been established, and various stages of drought have been announced, it was made law that it is illegal to wash the car at home, for water conservation purposes, and it had to be washed at the car wash.

It was also illegal to water the lawns, and gardens, etc. Whilst this was going on governments were watering their nature strips, lawns, etc, flaunting the law in front of the general populous.

The government told the masses to wash their cars at car washing facilities, as this would save water. This was far from the truth, as the water used by the car washing businesses, came from the tap which supplied the same water to domestic clients, and was Not recycled, as depicted by the government.

Interviews of many business owners indicated that it was a government scam, which made many owners wealthy and was not about water savings.

Given that there is a deliberate cover up of fraud especially if emanating from governments, there will be no Royal Commission or independent inquiry to the dealings and the defrauding of public funds by the Victorian government.

Currently Melbourne is under Stage 2 water restrictions, which should have been lifted a while ago, given the official dam capacity levels.

Another clear indication of just how corrupt the government really is.

This is a new propaganda machine started by the major networks (authorities) in order to win over the general populous into believing that the information provided is true and accurate.

News media companies are conducive to government policies and agendas that are represented by the government of the day. This holds true for all types of governance from Aristocracies, Democracies, Dictatorships, Monarchies Oligarchies, throughout the Eastern and Western political worlds.

The bias of the mass media in modern society has been well documented by sociologists, scholars, and to a lesser extent, politicians and lawmakers.

The news media is often caught out not reporting accurately, either intentionally or in unwittingly, not only by the masses, but also by other institutions and/or government departments.

An example of inaccurate reporting is that of by the government’s police media liaison office, which in many cases provides misleading information with regards to matters of criminal conduct by either individuals or associated gang members. This is a well known fact to the personnel involved within the departments.

One strict agenda of the mass media, is to keep the general population entertained, rather than educated. One method of achieving this is to keep the masses entertained with trivial matters, simultaneously dumbing down the viewer.

Media outlets work hard to provide entertained that is of little value to the social and moral well being of the community at large. This is done on purpose to lower the values of the general population, which in order creates social unrest, which is a diversion from attentions being focused on the corrupt dealings of politicians and governments.

Police have been involved in a harassment claim scam that has cost the taxpayers millions of dollars in false claims, in cahoots with magistrates under the watchfull eye of the disgraced Victorian Police top dog Simon Overland.

Information has been obtained from a reliable source, that Victorian police have worked together with corrupt magistrates in scamming the public's funds with false claims of harassment.

The manner in which it was done, was that the police would conceal Personal Video Recorders (PVR's) and record the alleged harassments. The claims would then follow the standard procedure until they would reach the courts, and payout were awared to police.

This scam would become so rampant that the police heads would tell the officers to stop this kind of practice, as it was getting out of control.

Police constantly liaise with the mass media, to determine which stories make it out into the public arena. Stories are also printed which are deliberatley inaccurate, in order not to inform the populous of the real nature of an incident. This is practiced more widely than the public is aware of.

The politics is to only inform the general populous of certain matters only, whilst covering up others. This is a strict policy that must be adhered to, and must not be broken via the official channels.

The media bosses are responsible for the reporting of the stories, irrespective of whatever information is obtained, which must not make the light of day until approved behind closed doors. This is done at either the lodge level or the political level.

Cabbie jailed for raping sleeping woman

A taxi driver who raped a female passenger while she was asleep on the back seat of his cab has been sentenced to eight years in jail.

A Brisbane District Court jury took one hour on Tuesday afternoon to convict Gurpreet Singh, 24, of rape and sexual assault.

Singh had pleaded not guilty to the charges because he claimed the 25-year-old woman had agreed to sex.

However, the jury was shown CCTV images from the cab that showed Singh fondling the unresponsive woman's breasts and kissing her neck before having sex with her.

During the trial the court heard Singh picked up his passenger in the early hours of November 29 last year.

Prosecutor Shauna Rankine said the woman, who had been drinking with friends in Brisbane's Fortitude Valley, fell asleep within minutes of getting in the cab.

She woke up to find her taxi driver raping her, the court heard.

The woman ran from the cab and told her brother about the incident, and then reported it to police.

She gave evidence in closed court on Monday and broke down in angry tears outside after the ordeal.

The court heard on Tuesday that the attack had had ongoing effects on the woman and she had redeveloped an eating disorder.

In sentencing Singh to eight years' jail, Judge Brian Devereaux told him he had grossly breached his duty of care.

"You took advantage of a situation and committed an atrocious act, so the community condemns that conduct, and I'm conscious of the need to deter others," Judge Devereaux said.

Man on 99 child sex charges gets bail

A 63-year-old man charged with 99 child sex offences, including obtaining under-age prostitution, has been granted bail.

Richard Paul Baxter, of the Brisbane riverside suburb of St Lucia, was arrested on Monday afternoon as part of Queensland Police's Operation Juliet Ostrich.

He has been charged with 94 counts of indecent treatment of a child, one count of making child exploitation material and four of obtaining prostitution from a child under 16.

The offences are all alleged to have occurred at Runcorn in Brisbane's southeast between October 2004 and September this year, and involve a single female child who was aged under 16 at that time.

Baxter appeared in the Brisbane Magistrates Court on Tuesday morning, where his lawyer Adam Magill made a bail application on his behalf.

Mr Magill told the court his client had lived in Brisbane for 50 years and was not a flight risk.

He would be contesting the charges, he said.

Baxter was granted bail on a number of conditions, including that he have no contact with the alleged victim and her family, that he surrender his passport and that he report to police.

The matter has been scheduled for mention again next month.

Smart meters rolling out in Port Phillip

Minister says you have the power to defer.

WITH the rollout of smart meters about to kick off in Port Phillip, one St Kilda body corporate manager has reported being offered financial inducements to install the meters.

“We were offered money in the form of payments, which is against the law,” one prominent body corporate manager, who declined to be named, said.

Other energy providers have rolled out smart meters north of Balaclava Rd. Citipower is about to start the rollout south of Balaclava Rd.

The apartment manager said Citipower did not offer any inducement but he declined to name the provider that did.

“Somebody is making a packet here and none of the regulators or authorities are looking into it,” he said.

Energy and Consumer Affairs Minister Michael O’Brien said the State Government would be concerned “if inducements were being offered and would follow up such claims if more details were provided”.

Mr O’Brien has reiterated his advice to customers that the meters could be stalled or deferred.

“Consumers who do not want a smart meter are able to refuse the installation until the State Government’s review of this new equipment is completed,” Mr O’Brien said.

They are then placed on a deferral list.

Citipower, just one of the energy providers in the area, will start the rollout in Port Melbourne and South Melbourne next month.

St Kilda is expected to follow in early 2012.

Citipower spokesman Drew Douglas said customers would receive two letters before the installation.

“There is a 10-day window between the letters and the installation,” Mr Douglas said.

He said this is the best time to tell them if you want to defer the smart meter installation.

The review of smart meters has been recommended by the Auditor General.

Phone tapping runs rampant

PHONE tapping is running rampant because of a lack of scrutiny of applications by police and others, the Ombudsman has warned.

George Brouwer revealed yesterday that no one examined the merits of why the Office of Police Integrity bugged telephones.

He could find no evidence the OPI had illegally tapped phones, but said that it, and Victoria Police, should be subjected to more rigorous scrutiny to ensure that all bugging was justified.

In a report tabled in State Parliament yesterday, Mr Brouwer recommended changes so that the OPI, and the new anti-corruption body that will replace it, have to argue merit as well as legality when applying to tap phones.

Every one of the 179 bugging applications made by the OPI since 2007-08 was approved.

Mr Brouwer heard allegations that the OPI had abused its powers when it bugged the phones of former police deputy commissioner Sir Ken Jones and Tristan Weston, an adviser to Police Minister Peter Ryan.

Mr Brouwer expressed his frustration yesterday that he had been unable to fully investigate allegations that the OPI had been abusing its powers to tap telephones.

"Witnesses have also raised concerns with my office regarding the OPI's alleged overuse of telecommunications interception powers - particularly, but not exclusively, in the investigation into Mr Jones," he said.

"Due to Commonwealth legislation, I am not able to investigate the OPI's alleged use of telecommunications interceptions."

He warned the lack of scrutiny of warrants used by the OPI, and by Victoria Police, could lead to a "situation where an opportunity for the improper use or overuse of interception powers could go undetected".

Unbeknown to most of the general populous, the humble pocket wifi router is yet another tracking device.

From a Brisbane based I.T. company, a security seminar was recently held dealing amongst other topics, privacy issues.

When a mobile router such as the ones shown in the illustration, irrespective of their branding, most of which are made by Huawei, is connected to the mobile tower network, via the users telco provided sim card, there are mobile status fields which are used in diagnostics tests. Some of these fields included are cellid, RSSI, Eclo, RSCP and Service Status.

It has been a well known fact within the industry that mobile phones are able to be tracked / traced via cell tower triangulation.

It should also come as no surprise that this is also true for pocket wifi routers.

Pocket wifi routers also track the users movements, even without an inserted telco sim card.

Independent test results have shown how effectively the users pocket wifi router can be located to within only tens of meters accuracy, depending on the environment, even smaller tolerances.

Invasion of privacy of the masses is becoming more and more predominant, supported by the new laws that are being passed to allow greater invasion of privacy with the backing of the business community, with the excuse of 'marketing'.

There is very little that Mr. Joe Average can do to stop companies obtaining information about him (in the name of marketing), to hold and sell to others.

Governments are deliberately taking no action to protect the privacy of individuals.

Doubt on independence of bug watchdog

PHONE tapping watchdogs who will sit in on secret court hearings will get their instructions from politicians, it has been revealed.

The admission by Andrew McIntosh, minister in charge of setting up the new Independent Broad-based Anti-Corruption Commission (to replace the OPI), has cast doubt on the independence of the so-called “Public Interest Monitor”.

It would mean that potentially, the minister would have knowledge of covert investigations into his political colleagues.

Asked who would brief the Public Interest Monitor, Mr McIntosh said: “Ít will probably be no doubt the minister responsible for the establishment of an anti-corruption commission.

“Or it may be the department. But the reality is, it will be the Government that will do the briefing on this person to appear on behalf of the public interest.”

At that point, the press conference was shut down and Mr McIntosh refused to answer further questions.

Repeated warnings that it is too easy to bug, track and spy on Victorians have apparently been heeded by the Baillieu Government.

The fact every phone tapping application made by Victoria Police and the Office of Police Integrity in the past three years was approved helped persuade the Government a crackdown was needed.

All 1271 applications were granted and only two of a further 423 applications for other surveillance devices have been knocked back since 2007-08.

Concerns held since being in opposition that the OPI's extraordinary powers were not being adequately scrutinised also contributed to the Government's decision to make it tougher to tap telephones and secretly watch Victorians.

It will today introduce legislation to establish a Principal Public Interest Monitor, who will be supported by deputy monitors.

A monitor will be in court every time any agency seeks a covert search warrant or makes an application to bug a telephone or install surveillance equipment, such as tracking or listening devices or hidden cameras.

Monitors, who must be lawyers, will represent the interests of the agency's targets to ensure the use of such intrusive powers is justified.

Mr McIntosh said yesterday the monitor would test the content of the material being relied on by the agency applying for the bugging or other warrant.

"At the hearing, the Public Interest Monitor will be able to ask questions of the applicant and cross-examine witnesses," Mr McIntosh said yesterday.

"The monitor will make submissions to the court on the merits of the warrant application, and any terms and conditions that ought to be imposed.

"Increasing accountability of law enforcement agencies through independent oversight strengthens the fabric of our democratic society and the rule of law, which is why we are establishing the Public Interest Monitor."

IT'S the tax she said we would never have and the public doesn't want, but Julia Gillard was so elated over her carbon scheme win even her bitter fight with Kevin Rudd was forgotten as they embraced for a kiss.

As Labor, Green and independent MPs celebrated the tax passing through Parliament's Lower House yesterday, the Herald Sun can reveal businesses have already been caught ripping consumers off with price gouges in its name.

The Prime Minister heralded the win as a historic moment in the fight against climate change.

But Opposition Leader Tony Abbott said the nation had been betrayed "with a kiss" - and gave a "pledge in blood" to repeal the carbon tax if he became PM.

Meanwhile, the consumer watchdog is gearing up for a carbon tax blitz to protect consumers.

Australian Competition and Consumer Commission chairman Rod Sims revealed some taxi drivers had already been caught trying to add a "carbon levy" to fares, while a few companies were being probed for price rises that were "just silly".

Mr Sims said the ACCC would launch a nationwide campaign and issue detailed guidelines showing what price rises would and would not be allowed.

"If anyone is putting up prices now, they're way ahead of the game," he told the Herald Sun.

"We've had a few potential cases of people saying things that are just silly, and reports of taxi drivers adding a 'carbon levy'.

If people are making claims that price rises have been caused by the carbon tax, they must be able to substantiate them."

The ACCC has been given $12.8 million to play the role of carbon cop and Mr Sims said it would make sure consumers were not ripped off by dodgy businesses wrongly blaming the carbon tax for price rises.

After 40 hours of debate and speeches by 125 of the 150 Lower House MPs, independents Rob Oakeshott, Andrew Wilkie and Tony Windsor and Green Adam Bandt voted with Labor to pass the 19 bills associated with the carbon tax.

It now needs final approval from the Senate next month, which has been guaranteed by the Greens, meaning it will begin on July 1 next year.

A jubilant Prime Minister Julia Gillard embraced and kissed many of her ministers after the legislation was passed by two votes.

"This is a significant day for the Australian nation, not only for Australians today but for the generations of children to come, who will live in a cleaner environment as a result of today's legislation," she said.

It will impose a tax starting at $23 a tonne on the 500 biggest polluters.

Electricity prices are tipped to rise by 10 per cent but overall living costs by just 0.7 per cent.

Households will receive tax cuts and welfare increases to compensate and the Government claims low-income families will be better off.

Ms Gillard said calls to delay the carbon tax would cost $5 billion and that Opposition Leader Tony Abbott would be "marooned by the tide of history".

Mr Abbott said the PM would be haunted by breaking her election promise not to have a carbon tax.

"This Prime Minister shouldn't just say sorry, she should resign," he said.

"We have witnessed the unseemly spectacle of government ministers celebrating a betrayal. They celebrated their betrayal with a kiss."

Mr Abbott stepped up his promise to repeal the tax, saying it was "a pledge in blood - this tax will go".

Greens leader Bob Brown said: "This is a great big green day for Australia."

About 85 mostly middle-aged anti-carbon tax protesters were thrown out of Parliament for repeatedly interrupting Ms Gillard during question time by chanting "no mandate, democracy is dead".

Thousands wipes from super accounts as share markets plunge

SUPERANNUATION funds took another major hit this week as plunging share markets wiped almost $2000 from the average account.

Since the start of the financial year, the average superannuation account has lost $6500 for every $100,000 in it, according to research company SuperRatings.

After another roller-coaster ride on the Australian share market, which has lost more than $60 billion this week, nervous super investors will be focused on the International Monetary Fund, which meets this weekend.

Jittery Australian investors rallied yesterday after heavy falls on Wall Street, with the All Ordinaries falling only 1.6 per cent to 3978 points - compared with falls of between 3.5 and 5 per cent in Europe and America.

And the Australian dollar recovered some ground to be trading at US98c - though it is still way down on its record high of $US1.10 on August 1.

But the market is demanding more action from political leaders and central banks to stop panic as concerns grow that the US is heading for a double-dip recession, China is weakening, and Greece may default next week.

Prime Minister Julia Gillard yesterday urged Australians not to be spooked by the turmoil.

She said Australia was the envy of the world, with a strong, resilient economy.

"The fundamentals of the Australian economy are strong - low unemployment, low public debt, a strong banking system, growth, employment prospects, record terms of trade, hundreds of billions of dollars in the investment pipeline," she said.

Ms Gillard is one of seven world leaders who signed a joint letter calling on European leaders to resolve their debt crisis.

SuperRatings analyst Nathan McPhee said the renewed turmoil had doubled super losses in the past three weeks.

At the end of August, SuperRatings reported a 3.1 per cent loss for "balanced" funds so far this financial year. Yesterday, however, the firm estimated the loss had climbed to almost 6.5 per cent for a balanced option fund.

"Basically, it's still just a case of staying the course and don't try and time the market. For anyone thinking about retiring soon, they should get financial advice before making any decisions," Mr McPhee said.

PM's $140,000 'stunt' to promote national broadband network

THE Federal Government spent $140,000 on a single publicity stunt to announce the first seven customers to sign up for a free trial of the NBN, it has been revealed.

The launch in independent MP Tony Windsor's northern NSW seat in May was attended by Prime Minister Julia Gillard and Communications Minister Stephen Conroy, as well as NBN Co boss Mike Quigley.

The Government has admitted the cost of the event, which the Opposition calls a "giant publicity stunt", was $138,474.05.

It was organised to show the PM "switching on" the first mainland NBN connection in Armidale.

It was later revealed that only seven retail customers in Armidale had actually signed up for the free trial prior to the launch - despite 3000 homes in the area being NBN ready.

Ms Gillard at the time described the NBN as "the greatest infrastructure project in this nation's history."

Answers provided by NBN Co to a parliamentary inquiry into the broadband roll-out also have revealed the Government-funded monopoly has leased top-of-the-market office space in Melbourne and Sydney to base it operations.

Documents seen by the Herald Sun show that NBN Co has leased office space in North Sydney at $3.1 million a year - or $512 per square metre.

This would put the office in the highest quality space - regarded as A grade or premium real estate.

In Melbourne, its office rental costs are even higher - $535 a square metre - but due to the smaller size costs $2.46 million a year.

Liberal Senator Simon Birmingham, who put the questions to the company during a Senate inquiry, said the cost of the launch was unacceptable and with four similar events subsequently held in other states, the total cost of publicity already could be close to $700,000.

"Such is Labor's propensity for wasteful spending that even the flicking of a switch comes with a whopping great price tag," Mr Birmingham said.

"If Labor had any regard for taxpayers' money it would refund the cost of these blatantly political media opportunities.

"With expenses like these it is little wonder NBN Co has sought approval for price rises 5 per cent above the inflation rate."

Mr Conroy said NBN Co's spending was a matter for them, but "the Government expects that NBN Co, as a wholly government owned enterprise, will make reasonable and responsible spending decisions."

The documents also reveal that by December 31 this year, it is estimated 1427 staff will be employed at an average yearly wage of $145,000.

The NBN, it is claimed, will offer internet speeds 10 times faster than offered now.

Sacked lawyer fights back over murky police affair

AN underworld consultant deputised by former chief commissioner Christine Nixon allegedly abused his position to conspire with senior officers to concoct a false Victoria Police investigation and leak sensitive police documents.

Court documents allege this was done to pressure a wealthy immigrant to settle a civil matter.

The documents reveal new details of a murky affair that damaged Ms Nixon's reputation after an underworld consultant she personally appointed, Kerry Milte, was revealed to be a conman.

The affair involved Crime Department boss Cdr Rod Lambert and led to the 2005 sacking of Christopher Antony Dale, a partner at law firm Clayton Utz.

Mr Dale was sacked after the law firm alleged he and Mr Milte had used "rogue police" to leak documents and concoct a false police investigation.

The firm alleged the conspiracy was designed to force Korean businessman Che Sul Won to settle a civil matter against one of Mr Dale's clients, Cheuna Schmidt.

The affair also ruined the careers of an Australian Federal Police officer who leaked immigration records - a major embarrassment to Clayton Utz as the department was a client - and a junior VicPol constable.

Now, Mr Dale has launched legal action in the Supreme Court, claiming his dismissal was unfair because he was never charged or convicted over the affair or found guilty of misconduct.

According to Mr Dale's statement of claim, Cdr Terry Purton told the firm's board in September 2005 that Mr Dale's behaviour was "both criminal and unethical", even though he was never charged.

Mr Dale's statement of claim also includes a report by Barry O'Keefe, SC, whom Clayton Utz bought in to investigate.

Mr O'Keefe claimed Mr Lambert leaked documents to Mr Milte, who in turn sent them to Mr Dale.

"The strategy that was applied to Mr Won was that he was made to think there was an official police investigation into his activities with a view to a prosecution," Mr O'Keefe found.

But Mr Dale says none of the accusations levelled at him was substantiated.

Navy rapist treated victim like a prop

A NAVY sailor jailed for raping a sleeping female colleague while filming on his mobile phone treated her like a prop, a judge said.

Keith Eric Calvert, 24, turned the camera on himself and gave the thumbs-up signal after digitally raping the woman, who was lying face down and unconscious on a bed after a night out drinking.

County Court Judge Michael Tinney said the footage was disturbing.

He said the victim "lay inert, silent and motionless, out to the world ... she was entirely unconscious".

He said Calvert held his phone in one hand while penetrating the 18-year-old with the other, treating her "as no more than an object or a prop".

"You should be ashamed of yourself," Judge Tinney said, calling it "disgraceful conduct".

Calvert's lawyer, David Sexton, had argued that bragging about sexual exploits and videoing them was part of the culture at the HMAS Cerberus training base south of Melbourne.

Calvert was found guilty last month of digitally raping the woman in a Melbourne home after a drunken night out at Crown Casino with five male colleagues in January, 2009.

The trial was told the woman stripped to her underwear during a game of truth or dare before the assaults. When Calvert tried to film her in this state of undress, she told him to stop.

Judge Tinney said this should have alerted Calvert to her attitude.

The woman was unaware she had been raped until three months later, when a colleague revealed he had seen sexually explicit images of her with Calvert.

Judge Tinney ordered Calvert to serve 3 1/2 years' jail before being eligible for parole.

VICTORIANS are losing $300,000 an hour on the pokies at pubs and clubs - $2.6 billion in the past year.

The losses are $55 million more than in 2009-10 and come as Victorian clubs admit they are spending, on average, 5c out of each dollar of net revenue on direct community benefits.

Some clubs have claimed the cost of darts, beer gas, Sky Racing subscriptions and staff drinks as community benefits.

No club declared spending any money beyond the legal minimum on problem gambling.

Victoria's most lucrative pokies venues are pubs, and the Epping Plaza Hotel brought in the most ($21 million) in 2010-11.

Other top venues were Werribee Plaza Tavern ($20.6 million) and the Plough Hotel in Mill Park ($20.2 million).

Hotels must pay 8.33 per cent tax towards the community support fund, which is controlled by the State Government.

But clubs are entitled to avoid this tax if they can show they have spent 8.33 per cent of net pokies revenue for the community's benefit.

An analysis of documents lodged with the Victorian Casino and Gaming Authority show that 5 per cent of club revenue went to direct community benefits.

This includes donations to charity, maintenance of club sporting amenities and subsidised food and non-alcoholic drink for members.

About 1 per cent of pokies revenue was directed to external charitable causes.

Indirect community benefits, which include club operating costs, soaked up 23 per cent of pokies revenue.

Clubs Victoria executive director Richard Evans said clubs were non-profit groups, as distinct from hotels.

"They're very conscious of providing a benefit back to the community," he said.

"They can't take a dividend. They return all their surplus back to the club."

A spokesman for Gaming Minister Michael O'Brien said the rules had been set by the former government.

"(We are) keeping a watching brief on claims to ensure that the scheme is working effectively," he said.

"The revenue that clubs receive from gaming is important to assist them to keep their doors open.

"These funds are used to provide club facilities for members as well as keeping thousands of people in work."

Teenager charged over fatal stabbing

A TEENAGER has been charged with murder in relation to the stabbing of a 20-year-old man found dead in a Dandenong carpark stairwell.

The 18-year-old Frankston man was arrested at 2.45pm yesterday and was later charged after being interviewed by homicide detectives over the stabbing death on September 6.

The victim, from Berwick, died after being assaulted in a carpark of the Dandenong Plaza Shopping Centre, allegedly after an argument over alcohol hours beforehand.

Police received reports regarding a brawl involving more than a dozen youths near the library, across the road from the car park, shortly before the stabbing.

The teenager will appear before a children’s court on September 19.

NO prison officers have been disciplined even though the fatal bashing of Carl Williams was captured by a live CCTV feed that was not picked up.

Authorities have acknowledged systemic issues in Barwon Jail after Matthew Johnson was able to bludgeon Williams to death with an exercise bike pole.

But the Baillieu Government has vowed to stand by Justice Department secretary Penny Armytage amid questions over her approval of moving Williams from isolation at the prison into a unit with Johnson and Tom Ivanovic.

Johnson has told how he could not believe he had time to bash Carl Williams eight times in the head and drag his body into a cell.

The man who calls himself "The General" had expected prison guards to storm the high-security Acacia Unit 1 well before he rained down his eighth blow in full view of the dayroom's two security cameras.

"In my mind I thought the officers would have got there before I finished hitting him," Johnson admitted during his trial.

A coronial inquest will investigate how Carl Williams was able to be killed.

The Herald Sun has posed crucial questions to Corrections Victoria about the murder.

A spokesman last night acknowledged its investigation had already identified "systemic issues".

But the spokesman said: "No prison staff have been disciplined and Corrections Victoria's focus has been to improve the way we operate across all prisons.

"There are further proceedings currently that need to run their course.

"Exercise bikes are still in some units, but Corrections Victoria has taken steps to secure loose parts."

Surprisingly, Johnson had access to an exercise bike - and a sandwich maker - in the unit day room.

Surprising because Johnson was involved in the gang bashing of prisoner Greg Brazel in the Acacia Unit's exercise yard 4 in October 1998.

A bike seat and sandwich maker were used as makeshift weapons during that assault on Brazel.

Questions have also been raised over the decision to move Williams into a unit with Johnson and Ivanovic.

Ivanovic, it was submitted in court, had former links with a former police officer who Williams was making claims against.

It is believed a secret briefing paper written by Ms Armytage to three senior ministers explains how she came to make the fateful decision, and identifies senior police and corrections officers who were involved.

A Justice Department spokesperson said Ms Armytage endorsed "high-profile or highly sensitive" placements based on factors including staff's risk assessments, prisoners' own views, and police advice.

A spokesman for Premier Ted Baillieu said: "The Government has and retains full confidence in Penny Armytage."

The mass media and subsequently the legal system has not mentioned that the prison guards have been payed off by the drug syndicate.

Even though prisoners are in confinement, their contact with the outside world greatly effects the guards standard of work.

A much more effective system has been established by prisoners in that guards are rewarded for actions that are conducive to the prisoner.

This has been well known to authorities for quite some time, as the corruption stem to the legals system's lawyers and judges.

There is deliberately no action taken against the corruption within the system.

Space junk crash-lands on Earth

THE biggest piece of US space junk to fall in 30 years has crash-landed, but the precise location is not yet known, NASA says.

NASA has repeatedly said there is only a "very remote" risk to the public from the 26 fragments of the Upper Atmosphere Research Satellite (UARS) which were expected to survive the fiery re-entry into the atmosphere.

The satellite fell back to earth today but the precise re-entry time and location "are not yet known with certainty", NASA said.

"The satellite was passing eastward over Canada and Africa as well as vast portions of the Pacific, Atlantic and Indian oceans during that period," the space agency said in its latest update.

On its Twitter feed, NASA said that if debris fell on land Canada was the most likely area.

The two dozen parts of the UARS that may have survived re-entry could weigh anything from one to 158 kilograms, the space agency said, and the debris field is expected to span 800 kilometres.

The tumbling motion of the satellite has made it difficult to narrow down the location. And given that the world is 70 per cent water, an ocean landing was considered likely.

"In the entire 50-plus-year history of the space program, no person has ever been injured by a piece of re-entering space debris," said Mark Matney, an orbital debris scientist at NASA.

"Keep in mind we have bits of debris re-entering the atmosphere every single day."

On Friday, a NASA spokeswoman said the US Department of Defence and the space agency were busy tracking the debris and keeping all federal disaster agencies informed.

The Federal Aviation Administration issued a notice on Thursday to pilots and flight crews of the potential hazard and urged them to report any falling space debris and take note of its position and time.

Also on Friday, Italy's civil protection agency warned that the probability of a crash in its northern territory had risen from 0.6 to 1.5 per cent, and urged residents to stay indoors, on lower floors, preferably near load-bearing walls.

Orbital debris experts say space junk of this size from broken-down satellites and spent rockets tends to fall back to earth about once a year, although this is the biggest NASA satellite to fall in three decades.

NASA's 85-tonne Skylab crashed into Western Australia in 1979.

The surviving chunks of the tour-bus-sized UARS, which was launched in 1991 and was decommissioned in 2005, will likely include titanium fuel tanks, beryllium housing and stainless-steel batteries and wheel rims.

"No consideration ever was given to shooting it down," a NASA spokeswoman said.

The craft contains no fuel and so is not expected to explode on impact, and NASA also said on Twitter that talk of "flaming space debris" was a "myth".

"Pieces of UARS landing on earth will not be very hot. Heating stops 36km up, cools after that," NASA said, adding that UARS contains nothing radioactive but its metal fragments could be sharp.

The US space agency has warned anyone who comes across what they believe may be UARS debris not to touch it but to contact authorities for assistance.

Space law professor Frans von der Dunk from the University of Nebraska-Lincoln told AFP that the US would likely have to pay damages to any country where the debris falls.

"The damage to be compensated is essentially without limit," von der Dunk said, referring to the 1972 Liability Convention to which the US is one of 80 state signatories.

Information has been unwittingly obtained from a Coles employee about a scam the company applied to its line of products, in this case fruit juices.

Coles and Woolworths are in an apparent ‘supermarket war’ in the eyes of the average consumer.

This supermarket duopoly has become undone on more than one occasion, in proof that they are ripping the customer off.

What Coles are doing with their line of product, the fruit juice, is that they are halving the amount of product, the so called fruit juice, and making up the remainder with plain water.

Many companies practice this kind of deceit, especially building firms with paints, and painting contractors.

Coles has applied this kind of deceit, i.e. the thinning down of product to its line of fruit juices.

Again another consumer rip off that the Australia’s consumer watchdog, the ACCC, is not seeing to, literally playing into the hands of the multi-nationals.

Another win for Big Business and a fail to the consumer.

Coles has appeared in the media for many allegations including price collusion, deceptive practices, scamming customers via petrol vouchers, and other trade practices offences.

Apple’s Australian Store Consumer Rip Off

Under Australian Consumer Law customers that purchase an item are able to receive a refund if the product they purchase is faulty or cannot be exchanged for another of similar quality or performance.

In Australia, Apple is subject to consumer laws as everyone else including the law mentioned above.

Many customers who have purchased a program from Apple’s Australian App store, find that it is either faulty, does not perform as described in the product’s performance documentation or is downright fraudulent or deceptive.

Many customers have lodged online remarks about the program, in the program’s user response section, requesting a refund.

These requests have not been attended to by Apple, which under Australian consumer laws is a breach of the law.

Apple as a result has profited from this fraud.

Whilst media and government organisations hide under the banner that technology is advancing at such a rate that it is difficult for the courts to keep up with the changes, this is quite to the contrary in many cases, as can be seen by the action of the governments.

One such case is with respect to revenue collection through speed cameras. Law a re introduced and passed through parliament speedily in order to install and turn on speed cameras.

So far, there have been no mass media reports of a consumer taking Apple to court over stealing $0.99 over a fraudulent program. Conversely if someone steals a paperclip with a value (for example) of $0.05, then they have a criminal record.

Police seize $200 million cocaine in mower shipment

A SHIPMENT of ride-on lawnmowers was the unlikely cover for a record 271kg cocaine bust with an estimated street value of $200 million.

Three men - two from China, aged 33 and 35, and a 20-year-old Melbourne man - are expected to face court over the haul.

It is Victoria's largest cocaine seizure and the fifth largest in Australian history.

A shipping container from Brazil arrived in Melbourne on August 19 via Hong Kong and was said to contain eight ride-on mowers.

An X-ray inspection uncovered anomalies and further investigations revealed 29 wooden boxes inside each lawnmower crate, containing a total of 271 vacuum-sealed plastic bags wrapped in tape.

Preliminary tests indicated the presence of cocaine.

Federal Police completed a controlled delivery of 60kg of the drug to an address in Melbourne's CBD, which led to the arrest of a man and the seizure of almost $230,000 in cash.

The maximum penalty for importing a commercial quantity of cocaine is life imprisonment and or an $825,000 fine.

Border protection manager for sea cargo Graham Krisohos said stopping the drugs from reaching the streets was a significant victory.

"This seizure is ... yet more proof that the Government's strategy on combating organised crime is working," he said.

"This is just not rhetoric - we are making a difference."

Federal Police national manager for crime operations Ramzi Jabbour said police were better equipped than ever in the fight against organised crime.

"This seizure and subsequent arrests are another example of our commitment to combating these criminal groups that jeopardise the health and safety of the Australian community," Assistant Commissioner Jabbour said.

Carl Williams murder accused had police files on jail cell computer

COPIES of police statements, including some made by Carl Williams naming former drug squad cop Paul Dale, were found on Matthew Johnson's jail cell computer, the Supreme Court has heard.

In evidence at Johnson's trial for Williams's murder, Sen-Det Mark Oxnam said police investigating Williams's jail death also copied statements of two other people - referred to as Witness A and Witness B - from Johnson's computer.

Sen-Det Oxnam, of the Driver Taskforce, said one of Witness B's statements related to the murder of a man named Mark Mallia.

"There was a second statement from Witness B detailing knowledge of the murders of Jason Moran and Pasquale Barbaro," Sen-Det Oxnam said.

"It had 'defence' watermarked across the statements.

"The third statement was in relation to the murder of Richard Mladenich; the fourth statement was the murder of Mark Moran; the fifth statement, Graham Kinniburgh."

He said other Witness B statements related to a conspiracy to murder Lewis Moran in custody, and Tony Mokbel and drug trafficking.

Sen-Det Oxnam said Witness A's statements included material about the murders of Michael Marshall, Willie Thompson, Victor Peirce and Nik Radev, and also about the drug trafficking activities of Carl and George Williams.

In his opening address, prosecutor Mark Rochford, SC, told the jury they would hear that Johnson "did not like people who gave evidence against others".

"The Crown do not have to prove motive ... but the Crown say there is evidence in this case that suggests Carl Williams was killed by Mr Johnson because he had made statements (to police)," Mr Rochford said.

In evidence this week, prison security and emergency manager Peter Hutchinson agreed consideration was given before Johnson and Williams were placed in the same unit.

Mr Hutchinson was asked if authorities were aware that Johnson did not like "dogs" (a slang term for people who inform to police).

"I'm not aware if that's Matthew Johnson's opinion," Mr Hutchinson replied.

Defence counsel Bill Stuart told the jury Johnson acted in self-defence when he killed Williams with a steel bike pole in Barwon Prison's Acacia Unit 1 on April 19 last year.

The trial before Justice Lex Lasry continues on Monday.

In Australia, the drug industry is worth approximately $18,000,000,000 annually.

Corrupt police and judges are on the criminal syndicates payrolls.

These criminals within the the legal industry and the police force are supported by both sides. Governments cover up their inadequacies, and protect the corrupt, whilst the drug gangs fund the lawyers.

Any exposing of the corruption leads to not only government persecution, but also results in dire consequences for the whistle blower.

Cash runs out to help vulnerable children

SUPPORT for hundreds of vulnerable Victorian teenagers is in jeopardy, with dozens of mentoring programs on the brink of folding.

Funding for at least 30 grass-roots projects is due to expire at the end of the year.

Volunteer co-ordinators warn troubled youths are now at risk of slipping through the cracks because the Baillieu Government has been too slow to respond to their calls for help.

And the Opposition says a funding announcement this week was a smokescreen for budget cuts to the sector.

Youth Affairs Minister Ryan Smith said "organisations supporting youth engagement" could compete for grants of up to $150,000 over three years under its Engage! program.

However Opposition youth affairs spokesperson Jenny Mikakos said this was a re-hashing of an old program - the Youth Participation and Access Program - worth $12.3 million over three years, due to expire this year.

Twelve community groups are about to lose $3.9 million in funding when the four-year Mentoring and Capacity Building Initiative expires in December.

They include Strathbogie Council's Making Links Mentoring Project, which has helped more than 50 disadvantaged and disabled youths finish school, find work, and engage with the community.

Project co-ordinator Linda Cusworth fears it will fold without new State Government funding.

"Engage! actually just means we're all going to have to compete for a whole lot less money," she said.

"And it's too late. By the time the grants are announced in late November ... we can't operate expecting you have only got a few weeks to go."
