THE police officer acquitted of manslaughter over a high-profile
Palm Island death in custody case has been questioned in court over his
use of force against a man who allegedly swore at him on the Gold Coast.
Luke Cole is accused of assaulting Senior Sergeant Chris Hurley
after swearing at him from a car in Robina on November 15 last year, but
Cole alleges the police officer put him in a “choke hold” before he was
even told he was under arrest.Cole has pleaded not guilty to the charge in a trial that began in the Southport Magistrates Court yesterday.
Snr-Sgt Hurley told the court he was at the scene of a traffic accident when he heard the offensive word yelled out.
Luke Cole pleaded not guilty to assaulting Senior Sergeant Chris Hurley last year.
He drove after the car and when he stopped the vehicle, he
said he bent down to the driver’s side window and asked whether anyone
called something out. Cole, who was sitting in the rear middle seat,
then allegedly admitted he had.
Snr-Sgt Hurley told the court he then asked Cole to get out of the vehicle.
“He came at me and I pushed him into the chest which slipped straight up on to his neck. I don’t know why but it did, perhaps sweat,” he said.
He said he held Cole up against the car with his hand around his collarbone but he was overpowered.
After that Snr-Sgt Hurley said there was a heated scuffle and he ended up over a roadside barrier, about 2m from where the car was parked.
During cross examination, solicitor Sam Jackson suggested Snr-Sgt Hurley was angry.
He suggested his client was put in a choke hold before he was told he was under arrest.
Snr-Sgt Hurley denied all Mr Jackson’s suggestions.
Ten years ago Snr-Sgt Hurley arrested Aboriginal man Cameron Doomadgee for swearing and he was found dead in his cell a short time later.
